Hi fellow members,

I was involved in a traffic accident on Sunday early morning about 12 - 1am. I was at Tanjong Katong Road near Punggol Nasi Lemak, going at 10-20km/h, there I was slowing down and making a right turn into one of the small lanes when i was at the right lane already. After doing the neccessary checks, I inched out and proceed with my turn. Then, a taxi sped from behind using the opposing lane and overtake me on my right side, hitting the whole of my right side from my rear exhaust all the way to my handlebar. His damages was his rear passenger glass window cracked.

Also, just at the right time, TP was patrolling that area and saw the accident. But since I didn't ask for ambulance, they did not log the case. However, I believe they saw the whole incident and also the uncle didn't run away because the TP was there (which he wanted to).

I submitted a claim to my insurance company (AXA), and SMRT called me up to ask me for my estimates for repairs. In addition, they told me that if I want to claim against them I must get a lawyer, if not I won't be able to claim against them which sounds like they are trying to scare me.

Thus, what I need help with is,

1. What are my chances of winning the case?

2. Did they skip standard procedures by contacting me directly without liaising with my insurance company?

3. If said I do need a lawyer, is there any good recommendations?

4. My insurance is 3rd party, so is it true that I have to fork out money to repair my bike first, then if i claim successful then I will cover my cost from there?

5. SMRT say they will provide the 3rd party surveyor, is it reliable?

6. Can TP themselves be a eye-witness for my case?

Bro, maybe i can help u just a little here and there....

Firstly, yes it's true u do need a lawyer.... Some bike shops repair ur bikes first for u then claim later cause they have their own lawyers to fight.... So it all comes down to did u buy from the correct shop... Go consult them...

Second, is ur statement done...? A statement should be within 24 hours of accident... If not done, contact MARS immediately.... Tell them u were unaware... And remember this in future coalitions... Call the authorities straight if other party is from government bodies.... One thing i know for sure, SMRT very brutal... U don't take action first, DIE liao... Don't take it lightly... So i suggest Statement, then bike shop bro... Do it fast... If bike shop don't repair, go and find a shop that will... Cause if ur case can fight, they will fight for u....

And Third, what the hell was that bloody TP doin....???!!!!! He was at the scene, he must have a statement at least... This will help in ur mitigation.....
