Hi guys, asked my friend about my situation, he direct me to this site. This my first post, guess it's rather a unhappy one. pardon me.

 

Here goes, I bought a bike under hire purchase from a motorshop, everything's alright till i default on 2 months payment. Actually at that point i wanna give up the bike already. Then the bike was towed to bikeshop. After 1 month, letter from LTA showing that my bike was being deregister from my name. So i guess that's ok, since i don't want the bike anymore.

After 2 freaking years, this month, motorshop just sent me a claim letter amt to 10k, stating reasons like storage fees, interest...blah blah blah. Of cos i was surprise! What the hell have i land myself into.

 

1) At the time when i wanna give up my bike, i only owe about 2k in installments, if bikeshop take over, confirm offset the outstandings, even if not, just owing to about a few hundred dollars. Thats why i thought it's settle after they took over the bike.

 

2) Bikeshop did NOT sent me any letters that they have taken over my bike. There's no letters stating that it was sold either. No information on how much i owe them if the bike was inturn sold to others.

 

3)I feel that Bikeshop should have inform me 2 years ago about it, rather than dropping a 10k angbao to me NOW Aug 2007.

 

4)Is there any chances that i can fight my case?

 

Do give advices my fellow riders....Thank you v.much.

wah..ur case sounds familiar..just like in the newpaper a couple of days ago..

 

first thing is when u owe them the 2 mths, was it alrd paid after sent back to bike shop?..coz sum bikeshops still want u to pay for the outstanding mths b4 they tow away ur bike...plus oso they will charge u for cancelling ur hire purchase with them if havent finish ur 2-3 yrs instalments..

 

secondly, to my understanding the bike shop shud hav given u a notice..so never assume that everything settle after u they take it back..storage fee, interest, cancellation etc will all b counted in..and they always will take a long time b4 their lawyer send u a letter..

 

u can go to CASE if u want to, but u must prove that nobody frm the shop notify u or any further charges dou..

 

i duno..i cud b wrong..but hope there be more advice for u bro..

Ur bike towed to bike shop as in reposessed by them?

 

You should receive a registered letter from them 2 weeks after they got ur bike be it repo or you push in. Its called the "5th Schedule". Letter will state all the breakdown for the bike.

 

In that letter, you will be given 2 option.

 

a) pay the outstanding months which you defaulted, collect the bike and continue the installment or,

 

b) shop will take the bike at $XXXXX and you got to top up the shortfall.

 

Now that your option is B, guess you can try to talk to them and sort things out. Pte msg me if you have any queries. :cool:

thk u guys for advices, yes i suppose it's the B option. i nv recieve the 5th schedule. shall be going for a war with them i suppose. im thinking of engaging a lawyer if it turns ugly. i can pay up the outstandings thats 2yrs ago, but not 10k.
