hi.. under this situation.

 

i sold my bike to another person.. we did a paper agreement to pay me via installment. and become my sub rider

 

but den he dun wan the bike already and left it at motor shop.. am i be able to sue him?

 

anyone pls advise.. cos once i ask my bike shop ppl.. they told me it useless to do up paper agreement between each other.. isit true?

unless your paper agreement have the lawyer seal?

Depends on whats written on the paper agreement. And whether you are willing to fork out the money to get a lawyer to write letters to your sub demanding payments or file further papers in court to sue him.

shud have gotten a lawyer to draft the letter up, lawyer acts as a witness too.

to my knowledge, any agreement between you and the rider is legal binding and in certain cases, even verbal agreements are valid too... The only issue is loopholes within the agreement if the agreement is crudely drafted.

 

In this case, if you wanna pursue with the matter, you can seek legal advice. But to what means? It will mean unnecessary costs for you & will it make up for the loss you have already incurred?

 

Best solution, get another reliable sub-rider (preferable a friend) or sell to bike shop. And oh!...warn other bikers about this fugger...

Correct. An agreement need not be written nor a lawyer seal. As long it satisfies the following:

 

1. Offer

Buyer offers to COI TS bike

 

2.Acceptance

TS accept his offer, and allows him to COI his bike.

 

3.Consideration(TS doing sth that he is not obliged to do)

In this case, by allowing buyer to COI his bike, he is already helping the buyer to save up on interest fees plus unecessary admin fees.

 

4. Intention to create legal relations

TS and buyer agreed to this deal to the benefit of both. As both of you are not rel;ated in any way, there is an intention to create legal intention in the sense that he is suppose to pay for the installment in exchange for personal enjoyment.

 

With these 4 points, buyer is bounded to pay the remaining cost of your bike. Should you bring this matter to court, it will cost you time and money, which is not feasible for a nominal object and sum. In this case, you can seek legal advice(I do know there are some firms that gives free legal advice) and probably check out the Singapore Mediation Centre for possible mediation. Clearly, the buyer is in a lesser position for an agreement has been reached.

Actually don't you think you are still in an advantage...the guy take paid a few months of your installment.

 

And the bike is still yours.
