Hi, i'm a fellow rider who needs help on the legal laws.

I've just took over, or COI, a bike from a fellow friend. Currently, he's due for another 2K plus of installments with a particular bikeshop. That aside, my main concern is not regarding this.

Upon carrying on, within a few days, it jammed. Seems that internally, the bike is knackered. To be specific, the shaft bearing broke and dropped into my running gears. So, damage wise, it goes all the way from shaft bearings, running gears, piston, block. I.e. full Overhaul.

The total cost of repairs were $2.8k. Mind you, when asked for receipt, they say i have to pay for gst. But after discussing, they agreed on absorbing. So, when i took the bike back, it was end of april. 2 weeks later, my bike starts to have startup problems. Towed back to bikeshop and they say they will check on it. Asked them to send for inspection too. So the second visit cost me bout $200; claiming on tow, inspection, and decarbonize the pipe. The result, a loosely fitted pipe and a total of 3k spent.

After this repair and inspection, bike became more unreliable. So, rarely used the bike. One day, wanted to send the bike over to change tyres from another bike shop. He specialised in the particular bike i'm having and asked me y is my bike sounding very loud in the engine. I told him that impossible, as i've just overhauled. I even changed parts. He asked what i've changed, i told him as written on top. He looked puzzled. He told me whether i would like to open up and see whats inside. I told him proceed. To my horror, my clutch plates were worned, the clutch housing gear teeth chipped. My biggest fear was when he showed me my block. It was exactly the same or much worse condition when i send in for the overhaul (this i know because i was there when it was dismantled). Even the conrod was grinded off , trying to hide the brand.

The mech, kind fella, told me how could i overhauled with that price when the block itself is an old model. Ie, the new model of the blocks are different. He also told me to go back to the shop. But this shop is the same shop that i'm still having COI.

So, my questions are: What should i do now? It will take another $2.8k(new block.etc) or $1.5k(polished block) to repair.Should i pursue a case against the shop? help!
