i got a question on behalf or a friend about overpay n i need ur suggestion..ps. i dont where else to post n sorry if it got nothing to do with biking...the story goes like this...

 

On May, My friend brother join a well known company as a full time sales staff..he only work for 3 mths n his last month was on July..he did not quit in a polite way..another words, he "cabot"...

 

but on Aug, Sept n Oct, he still received his salary on which he did not work for it..at first he didnt use the money, but after a while the money in his account, he decided to use it..

 

On Dec, he received a call from his previous workplace..He was told about the overpay n was told to pay back the 3 mths "salary" which amt to nearly $4k..he admit using the money n cant pay them back in one lump sum..so, the company suggest paying back by installment..he told them that he will get back to them on how much per month he can commit..

 

so, my question is, if he doesnt want to pay them back even with the instalment, what possibly could happen?? what i mean was can the company file legal action?? btw, the reason the company give for the overpay was the accountant is new n inexperience..

as they have records of ur brother's wrk days n timings..

n the pay he is supposed to get..

they can jolly well get back wat's theirs.. its the same as the atm wrong transfer thing.. r u going to stop the bank from retrieving back??

n i tink fire flames are going to start soon.. haahaa

The company's lawyer can send him a Letter of Demand for the erroneous payments. If there is no settlement between the two parties, the company can proceed to recover the money by legal actions.

 

At stake is not the $4000, but the integrity of the person. Singapore is very small, and words can get around quickly within the industry, and that may have a detrimental effect on his future career opportunities.

this is so true,

suggest your bro to pay back the amount, even how little it is via instalments.

this is SG you cannot "chabot" one.

 

further, your bro admitted that and acknowledged that he has been overpayed, so there is black and white, (other than the account statement). just tell him to be smart about it and pay back lor,

i'm sure the coy can negotiate how reasonable the instalment period and payments are.

that's not the point....its about doing the right thing...

first of all...legally the company can sue...

2ndly...if ur friend wants to be an @sshole with his greed....his reputation is going down the drain...wat goes around comes around.

whether is the accountant's mistake or not is another matter.. probably preparing for closing period that the dept have found out.. now that the company already found out.. better pay them back..
