Reloan Issue, HELP!!!

Hello all,

 

I recently did a reloan at a bike shop. The amount of loan is $3500 and after deductions of misc. fees, the cheque to be issued to the seller is supposed to be $2000+++. However, they now claim that they issued a wrong cheque of $3500 to the seller.

 

The seller has since left Singapore as he was an expat.. Now the bike shop wants me to pay up the difference or the will claim ownership over the bike.

 

I'm perplexed. Any advice?

so you already did a reloan as mentioned? how much was it for the reloan done at? bikeshop issued and pay wrong amount to seller is their own problem, nothing to do with you. i hope you stand on your grounds not to give in.

Yup. The reloan was already done last Monday.

 

The reloan was for $3500. But after deducting for insurance, 1st instalment and etc., the amount left was $2000+. However, they overlooked it and claim to have issued the cheque at $3500 to the seller.

 

Now they are asking me to get the money back from the seller, who i don't know which part of the world he is at now. Or the will claim ownership of the bike through the $3500 they have paid the seller.

Hey, bro, i duno if i can help. But to my knowledge, if the shop have made the mistake of issuing the check of the wrong amount, it is not ur fault nor they can claim the money back from you. Hence they r liable for the mistake not you. U need not to worry so much. IF they really claim the ownership of the bike from u as u mentioned, u can get back to them thru the law side.

they are just making noise and hoping not to make a loss by making U come up with the difference...if ur paperwork is all showing the correct figures...they can whine/sue all they want.And U are not legally obligated to look for the seller for them.

other than CASE, does anyone hava a good lawyer the can recommend? I need some legal advise on this issue.
