update:

representative from the company of the van called.

asked for my license plate number for police report [to confirm?] (maybe for them to claim insurance from their side?)

said they're not going to claim from me.

that's all.

yea i hope it's a positive outcome. coz i'm cocksure to argue for my side. i have already drawn a sketch of the whole scenario. i'm sure of it even though it was raining anyway. lol. yea definitely will update you guys here...

if they say they dun claim against you, its just their words. request them for black and white for any agreements. Godspeed to you. :)

u r rite bro that they will had a hard time claiming against you since there are no photos of the accident scene and no witnesses. however, you mentioned they wana make a police report rite? i duno whats their purpose of doing that..

since u say they r not claiming. ask the company r they willing to sign a form which both party acknowledge the fault or the claim. so they cant backstab u n go ur insurer for sure. by the way the form need to be submitted to the insurer so they will be kept inform if the other party was to claim against u..

 

the 2nd point then is police report mah from what i see.

they r asking for ur plate number, got a 'feeling' that they might be reporting this to e insurance co. so on e safe side, better sign this form.

 

since no picture taken, and only e rear light cover (cost abt $75 bcos i hit my rear Hiace light cover and replace it b4). Small issues doubt they wanna go til this extend.

i'm not sure if i should demand for a signed agreement because they SEEM very nice to "not claim anything from me". i'm afraid this might spark off some anger on their side and they might change their decision to go to the negative extent. should i wait a few days and see whether my insurer calls me (maybe?). but even then, i can just tell them that there're no pictures (and if they wanna play pang lidat, i can also create my own story, saying that this fella came up to me to ask for my number for some reason while i was with my bike, etc.)

 

i think i should wait a few days. sounds better? instead of provoking them. :/

u nv report ur insurer, anything they (ur insurer) can juz push it to ur fault n carry proceed on with the other party claim if not wrong.

 

if he find 3rd party workshop, i guess their story in chinese is got dragon n phoenix kind of claim LOL.

 

from u guys conversation, who hold the most liability too ? u dun safeguard urself no one cant. even if the other party claim u, not guarantee u will get know right?

 

some ppl on forum is like when renew then they know ages ago they kana claim before.

 

not to mention when it come to 4wheeler, the claim can be like WOW.

regardless of whether you or the company wants pursue the claim, you should make known to your issurance company of such incident, this is to safe-guard you in case of foul play from the other party.

 

personally, i do not see the rationale for the said company to pursue the claim when they themselves do not have confidence, especially for something that cost less than a hundred bucks to replace. rear side damages are open to contest as the vehicle cuts into the lane without making sure that there are sufficient allowance.

Question 2:

What follow-up action should a motorist take if another motorist offers to compensate him for damages caused to his vehicle at the point of the accident?

Answer:

Even if the parties agree to a private settlement, a report to the respective insurers is still required for record purposes.

 

Question 6:

I understand that every accident must now be reported. Would it be possible for some kind of memorandum of agreement to be signed by both parties in very minor accidents where two parties agree to settle on their own?

Answer:

A memorandum of agreement would be a private matter between the two parties, but it would not alter the requirement under the MCF that both parties now have to make a report to their insurers. A memorandum of agreement should not supercede or be regarded as a substitute for this process.

 

Question 7:

I am a new driver and I heard most of my friends and colleagues said that once you reported a minor accident to my insured policy company, your premium on next renewal would be heavily increased. If so, I would think that most motorists would not report minor accidents based on MCF method; they would prefer to settle privately. Please advise.

Answer:

The GIA reminds all motorists it is now their duty to report all accidents, no matter how small and regardless of whether or not there has been damage to their vehicle. The consequent impact on NCD and premiums are not affected by the MCF and will be determined by the outcome of the insurer’s investigations into the accident.

 

 

 

 

 

In the end its up to you. Must accept the consequences whatever the result is in the future.

TS, lesson learnt.In case of accidents,

a) do not argue.stay calm always

b) get the full details of the motorist/rider

c) snap a few pics of the damaged vehicle(s) and the surrounding area

d) inform yr insurance coy

e) inform TP

f) wait for outcome

g) pray hard

Do not trouble trouble unless trouble troubles you
