Hi guys had a near miss just now at tampines . No accident nth just near miss and was wondering if i really bang her whos fault is it?

So here is the case i was travelling along tampines st 22 i was travelling ard 60km/hr on the left lane.There was lorry and bus on the right lane waiting for right turn arrow hence my view was block. I was at the last arrow and the light turn amber suddenly this auntie cyclist with a kid sitting infront dash out from the right i bo bian if i brake cfrm will bang them becoz i already at the last arrow so i really do a paylon salom to 'siam' them.

Really give me a scare what if i really hit them deep in my heart i know i am not in wrong becoz i know they jay cycle but if i really hit them i think i be guilty for life especially for the kid becoz he got no control the auntie is the one controlling he can only sit there.:( so guys what if i really hit them? whos in fault?

If only time can roll back,i wish i can go back to my 2b times. Where bikers are friendly and helpful..

Lawfully, you will be at fault.

 

If such thing happens, I would blame both. You as the rider is suppose to slow down when approaching the traffic lights. The arrows on the road are there for a reason. As the aunty, she should be waiting for the green man to flash himself.

In this case its really very gray. Legally you are not at fault but also legally you are.

Why so?

1) You as a driver or rider have to look out for pedestrain NO MATTER WHERE OR WHEN OR HOW.

 

2) Her fault becos she is NOT ALLOWED CROSS. And its the right of way for vehicles to turn.

 

So this kinna case definately will go thru a long investigation.

Thus as a motorist we really have to pay alot of attention on the road. And also as a pedestrain we also have to pay alot of attention on road as well. End of the day if we take it for granted, anyone got hit will suffer in pain be it physically or mentally.

 

This kinna case need witnesses for your info. Thus having a on board cam is best for this kinna case. And also right of way doesnt really mean right of way. Look and see before you really proceed. Drive and ride and also walk safe bro.

yeah guess both of your are right we as motorist do need to pay 101% attention on road.But some time it really hard to predict, to me it seem like she hiding behind those bus and lorry i was going straight so i really can't see her. But seriouly how slow will your go when your reaching the stop line to check with bus and lorry blocking your sight on your right. Seriouly i dun see the need to stop until 30km/hr when light is still green and it 6pm where it the peak hour i think i will be horn to deaf by the driver behind.But still i am grateful nth happen if nt i really be guilty for life and i can kiss my lic gd bye

That is when experience comes in handy. You may wanna attend the HOV course. Its conducted by some of the riders here.

that's the problem with the cyclists in singapore. most cyclists travel on the road without following the traffic rules/lights.

 

anyway to answer your question, it may be probably a case of contributory negligence. this means it is your fault to hit them but the court will takes into various accounts like did the cyclist follow the proper traffic rule, were you travelling beyond the speed limit when turning and others. So your punishment will be lighter.

 

(but of course, your lawyer can always say you are on your way to visit a dying relative in the hospital so you cannot think/see properly when you ride, then you just need to pay a fine after hitting them?)

 

anyway glad you didn't hit anyone. ride safe!

Haha no i was not lane spilting i was travelling in the center of the most left lane. treasure my 12 point.lol:cheeky:

Hi bro i was not speeding road limit is 70km/hr i was travelling at 60km/hr.But just to ask we will still be at the losing end if we got the right of way and not speeding.will i be right to say that bro?:(

yea, even you not speeding you will still be the losing end. Ppl might complaint you and try to charge you. In the first place if that were to happen, you already in pain physically and mentally. So its a very troublesome thing that you wont wanna get into.

 

I think in here we enhance very much on safety.

I hit an old lady who was on the phone and dashed out on the road suddenly couple of years ago. I felt very guilty but i know its defo not my fault cos i cant be god and predict which of the pedestrian by the road wanna jump out on the road suddenly.

 

I 'swallowed' the fine for reckless driving and demerit points, which even till this day i honestly believe i don't deserve. The system makes it such that as long as u operate the vehicle when sh!t happens u must 'ta' (carry). So LLST.

 

I see those advert on tv asking drivers/riders to look out for pedestrian i always very angry. KNN, u leg to walk, no eye to see ah?

 

I always look out for my surrounding to prevent a repeat of that incident, but what i cannot control, i pray to god.

 

I suggest TS to do likewise if you feel worried. If no luck and god don't look out for you, then i guess such a person really kanna condemned.

Yea i remember watching one of the advertisement saying wat look out for me. knn they crossing dunno how to look out for themselves ah. Thats why i say the law doesnt really have justice at all.

yes, so long as we hit a cyclist/pedestrian, we are always in the losing end (only lose more or lose less). just be extra careful when riding on small road especially in neighbourhood area...

we may be at the losing end. but for them, it might mean losing too - losing their lives. :(

 

Remember this rule: Lorry/big vehicles > Car > Motorcycle > cyclist/pedestrian

That quote is good, though not 100% accurate =)

 

Just remember this simple thing - You're on a vehicle, you have RTT. Whether or not they hold any valid licence, there's no BTT/FTT/RTT for pedestrians.
