Accident: my Bike Shop decline to claim for me + ask me pay 150 for surveyor

Hi all,

 

This is my current scenario. Was eating supper last night and parked my bike at roadside, the car in front reverse and crash into my bike. Nobody was injured, but my bike was damaged so we exchange contacts, IC, car plate and he promised to take responsibility.

 

Now, i just brought my bike to workshop and i gave him the quote (300+), he claims is very high and ask me to claim his insurance, he dont want private settlement. made IDAC report and went back to my mech

 

He says

1. very troublesome, ask me to take the relevant documents that we will write for me and go to his insurance company to claim myself. (but from what i understand some workshops can claim for you, isit true?)

 

2. says if the fee is not accepted, and the other party sends a surveyor, i need to pay 150dollars??

 

Very headache for me now, cause mine is 3rd party so i can go to any workshop i wan.. but the workshop is not helping n instead very rude also, any one got any recommendations for workshop or similar scenarios that can share with me the outcome?

 

cause the problem is my claim is not very big then isit true the insurance company can dont pay me? i hope i dont have to end up paying out of my own pocket.. hope someone can share with me their experiences.. thanks

last time i direct to the other party insurer before. but the thing is u duno will that party twist the story or not. but i think if u know who is his insurer pls ask him to give u contacts, so u can contact his insurer and if possible they might send their own surveyor to do the assessing of damage.

 

but as for liability is still your words against his.

no need to pay what surveyor one. everything should be done without a penny from u. bikeshop dun help den change another shop. pm me if u really need some contacts to help u claim.

yeah TS..keep looking for the right bike shop to help u but in yr case,if u were to claim against that driver's insurance,its gonna be complicated cos U PARKED ILLEGALLY SO U R PARTLY TO BLAME FOR THE MISHAP.imho, u shd have settled privately with that freak asap..n were there any witnesses?u shd have recorded everything that dumbass told u.but 4 nw,contact Trixxy if u need help.he offered to help...gd luck buddy!

Why do you assume that parking "at roadside" must mean parking illegally?
