can other party claim me when i claim from them?

hi,

i just want to know if the other party can claim damages from me even though i can claim from them. because after 1 month then i received a letter from them that they want to claim frm me even though i think i successfully claim from them, because i do not nid to pay my bike shop for the repairs.

You think you successfully claim from other part? You mean you think only? You better go to the bike shop and clarify first.

that's what the traffic court is for i suppose, have seen plenty "peng wei" they peng as if they morning selling prata...!

as in because my repairs i dont have to pay, so doesnt it mean that i can successfully claim and the lawyer said the money claim some will go bike shop, pay lawyer legal fees and the rest is mine, not forgetting the repairs.

 

so since the lawyer said that and after like almost 1 mth or 1 mth plus i got my bike back i received letter frm other party lawyer. make me stress only

Yes they can claim from you, whether successful or not is another question.

More importantly, have you forwarded the claim letter to your insurer?

The bike shop handling your claim simply bear the cost of repair first, pending insurance claim. But that doesn't mean your claim against the other party is successful. More often the other party or the wrongful party simply just claim the other party first for the sake of trying.

did u hit the other party or the other party hit u? perhaps u can describe the circumstances of the accident? the bike shop may have claim against your comprehensive policy also (if u got comprehensive insurance)

i already faxed the documents to my lawyer he said he will write a letter to my insurance co. explaining why they should not pay the other party.

 

it was a jam that day at cte sle lane one and two jam so i was lane splitting and suddenly a pickup from lane 2 jus steer towards lane as there is a gap, he did not signal den i had no time to react. so i hit his side door.

 

fyi his pickup was rented and hes a pickup how can he go to lane 1 -.-
