Hi all, i'm in need of advice. Here's the scenario in point form:-

 

- Person A sent bike back to Shop

- Told shop he can't afford to pay for 2 mths & had it placed there temporarily.

- Bike shop send Legal Warning letter to settle outstanding 2 mths installment

- Bike still under Person A name

- Bike shop sent ANDY LIM(96483960) aka Legal Prosecutor to handle.

- Bike shop closed Person A Reloan installment account.

- Bike shop expect Person A to settle 5K outstanding in FULL.

- Person A had paid 1K so far & left with 4K+ outstanding UP TO DATE

- Bike shop insist that bike will NEVER be returned but owner still need to clear the outstanding 4K in full since the reloan installment account is already cancelled.

- Bike Shop Name: * will PM when requested.

 

Pls advice.. .thanks guys. :(

You're right, it does seem unfair... for the shop, that is. If Person A had a hire-purchase agreement with the bike shop and he couldn't pay for two months, the shop is entitled to repossess the bike, sell it off, and get Person A to pay the difference in contract and realised value, and expenses. It's a bike shop, after all, not a pawnshop - you can't simply leave the bike there for 2, or 4, or 6 months, then pick it up and start paying from where you left off. If everybody simply returned their bikes to the shop when they can no longer afford to pay and expect the shop to square it away for them, then there won't be anybody doing financing for bikes after a while.

You migh as well rephrased it as scenerio B.

 

If the person has sold off his bike, (which wont be possible unless there is a release of the log card by the bike shop at the LTA, there is another scenerio altogether which you obviously didnt know about yet. But until you do, no point us wasting our breath explaining too much to people who refuse to read aka listen.)

 

Settled the total sum? Which total? Including the amount of 'parking' at the bike shop?

I suggest that if Person A can't make the installments, and has the bike repossessed and sold, then he should go to the bikeshop and find some way of paying the outstanding amounts by way of installments. I would think that for the bikeshop, getting some money is better than getting no money.

 

I'm not sure I understand what you mean in the latter scenario where Person A had the bike sold off and had settled the full sum. If the bike is sold off by the bikeshop after it has been repossessed, and Person A settles the oustanding sums in full along with all the costs and expenses that are incurred by the bikeshop in repossessing the bike and having it sold, then there would be no further issue.

I guess people shouldn't buy a bike if they have no money.

 

Well, life's unpredictable bro and i think you should think twice before Posting that Bluntly without sparing a bit of your brain juice to think twice.. When u had it all planned... shi* happens u see.

 

Btw whut i think the best solution for this sorta scenario is when the owner's unable to settle installment,

 

1) they should call up the bike shop and negotiate. Tell them the earliest date possible that u can settle the installment.

 

Besides, bikeshops are run by businessman... and just like any other businessman.. i dun think they wanna have any LOSS especially when it comes to Money. Hope the rest of our bros and sis in SBF need not be in this complicated scenario. :)

If have $$ why arent you paying yr instalment now??

 

I do agree **** do happen at time. So nxt time do plan for the **** to happen, if not yr margin is too low to buy a bike. eg accident??

 

I think spare a consideration to the motorshop, what if everyone default on their instalment.

 

Normally in a hire purchase if you cant pay yr instalment the bike will be sold off and any proceeds will be use to pay off the outstanding loan. It is supposedly written in the contract. I suggest that you go down to the shop and negotiate with the shop and hopefully they can compromise.

Here is something even more unfair that I've heard of.

 

This person A, took 2 bikes from the same bikeshop, one bike for his brother/friend B and one bike for himself. Both bikes are under his name and installment plan because he is older. (The previous plan where older riders gets cheaper insurance.)

 

So person A and person B has a private agreement where person B will pay off the installment for his bike and until he reached the age, they will do the transfer to person B's name.

 

Now person A has been dilligent and paid off his installments properly. Person B has not.

 

So when person A want to collect his log card for his bike. The bike shop refused to release the ownership of the bike, just because person B defaulted and is yet to pay up the 2nd bike in full.

This issue occur to a dear fren of mine. It saddens me but eventually i got to find out that Owner's at fault for not calling the bikeshop up and make arrangements. Again Thanks. I'm just highlighting your Blunt remarks & response for the first line in ure post.
