i kana my first accident also on aug last year... skidded and hit onto the rear side of a car at the expressway...

then report straight to the insurance agent.. but then call the other party to private settle... he agreed and sign a black and white which he and i both have a copy of it.. so if he going to claim my insurance after i pay him.. i got this letter to defence me...

and also since i make report before i intent to private settle... the report can be cancel if they have send out...

:offtopic: the AXA staff that attend to me is CHIO!!!

Come on la my fren. i did not ask the TS to lied and give any false statement leh. i merely advice him not to make the mistake of admitting fault even before any investigation is done. He should still state the truth account of what happened and let the authority decided how much liability he has bear. i didn't say TS is right and the van driver is wrong. i dunno why must you use such a word on me.

How can you believe you do not bear 100% liability for drifting wide into oncoming traffic? The thread starter is being an honourable gentleman for admitting a mistake and being fair to the other party. Unless you have reason to suspect the other party was drunk, does not have a license or was not in sufficient capacity to operate his vehicle, what right do you have in expecting others to share the blame when you stirred the sh*t?

If someone drift wide into you from oncoming direction, would you rather he own up and compensate you or play punk with a law suit and fight it out over a long duration? Now you know why LordDevil called you that?

not true.

i got into an accident on 18th march 2007. after i recovered from the accident, i got a lawyer's writ regarding the claiming against me. that very same day i got an urgent mail from speedpost from my insurance company. they told me that i've yet to make a report from them, asking me to call them ASAP, which BTW was in 27th august 2007. they told me to come down in person to make the report.

the next month the case was closed. :) BTW my insurance was with AIG when i got into the accident. don't know about other insurance company but my guess is they work the same way.

rien d'autre que le max.

ok i'm sorry for using that word on u. but wad u posted make my blood boil and that is the only word that came to my mind at that point of time. it is a clear cut accident. how can u ask ts not to admit? put urself in the driver shoe, a bike going to head on with u but u are on ur own lane. in order to avoid head on, u turn away and end up crashing into the vehicle beside u or u mount kerb hit bus stop or u mount kerb hit tree/lamp post but the bike got away safely. how will u feel?

Exactly... I don't like to post negative things in forum, and i know you are the same. but i can understand if you can't help giving this chap a piece of your mind...

i would like to repeat myself that what i meant in my earlier post is not asking TS to claim that he

is right and fight a long suit with the van driver. Who dunno TS is at fault here? What i meant is to

ask him to remain silent and let the proper authority decide how much liability he has to bear

instead of trying to be the judge and make the decision himself. Coz what a person says could be

used against him which i'm advicing him not to make such a mistake.

What if the van driver make claims that is not due to the accident which amt up to a large sum of

$$?? You will never know! You dun know the driver's character at all and neither do i. hence we

must be careful. 害人之心不可有,防人之心不可*. Agree or not? But by admitting fault immediately,

you have no chance to fight when discrepancies arise.

I am not an *******. Mark mi word that if i ever meet such a situation, i will also allow the other

party to claim mi insurance w/o any question, provided he make appropraite claims.

I apologise as my post earlier cause misunderstanding. i re-read my post and realise i have used

the wrong words which toally bend what i wanted to say, hence i'll removed my post.

But i really need to clear my name of being an ******* who will shirk responsibility as i am not.

ur guess is as good as mine.... neway i have yet to make a report... i jus kol AXA say i hav acident n ppl wanna claim. den they mail me the GIA report ask me to fill in. i dun understan wat to write ther n ive misplaced the thing. btw GIA is all insurance company use... a standard accident report. neway u report now or not u still MUST go down to their office to make a report in person in few months time. same like police take ur statement at roadside still u must go to police station again to confirm the report. works something like dat.

good things come to those who wait

ok. sorry again for calling u that. dun take it to heart. glad u knew ur post cause misunderstanding. it is a case of wrong words used at a wrong place and time. forum is kind of hard to express well as only words are the only channel but not the tone, expression and body lang.

hi all, i think buttbutt has a point there abt not admitting liability.. u can apologise after the accident but you cannot put it in writing that it was all your wrongdoing.

i recall its written in our insurance policies somewhere along with drink driving clauses etc.

if u give a written proof of admitting it is your fault, your insurance company will not cover you anymore..

i had a case where a msian scooter rammed my car at a cross junction when the lights were in my favour.. he said he was wrong to run the light but i told him that he should not put that statement into his police or insurance report in case his insurance company withdrawls and my insurance company goes for him on a personal basis.. luckily there were no injuries on both sides and the case settled just after i sold my car 4 yrs later..

again, over 10 yrs back, my car got whacked by a drunk driver. cut long story short, i only wanted my insurance to foot the repairs, but since the guy was caught by police drunk at the wheel. his insurance refused payout and my insurance company went for his personal liability. i got a few hundred bucks, i think my insurance company went for blood and took several thousands for legal fees and costs....

having said all that, weather is wet. ride safely..

i would also advise u to private settlement with the van driver unless the repair cost more the 500 bucks...

if u private settle, try asking ur inssurance company whether they have private settlement agreement form... that time a car bang me n he compensate me after i sign a p.s agreement form from his insurance company which is ntuc.

inside the private settlement form, the state that how much he compensate me. i will not report the case to the police n i will nt claim from his insurance.

it will be betta u do a fund transfer to his bank acc so that got black n white...

end of the day as long as there is no major injury or death, negotiate with the party for a outside settlement. Should the deal falls out, let the law decides who is right or wrong.
