Need of advice.

this afternoon,got involved in an small accident.Went to shop with my wife on my bike.Went thru the carpark and infront of me was a 3 footer lorry.Lorry stop,i also stop.Suddenlly i noticed the lorry was moving backwards,i horn 3times but was too late and damaged was done.My bike had a broken nose and cracks.The lorry driver claims he didn't see me and also didn't hear my horn.He wants to settle privately and offered me $40 bucks.WTF:angry: ..i showed him my lense protector and told him that his $40 bucks can buy me another protector and not the repairs.Particulars had been exchanged and he's waiting for me to get a shop quotation for the repairs.

 

Question is:-

1)Wat if he refuse to pay for the repairs.

2)if he wants me to claim from his insurance,how do i go for this.Do i need IDAC asessment before proceeding for the repairs or juv leave it for the motordiam to claim for me.

We didn't report to any Authorities as we agreed to settle it privately.

3)The accident happens ard 4:30 pm.Is it too late to make a report if he backs out from the deal?

 

This is my 1st claim in 10 yrs of riding.Hope u guys can assist me in this matter.

His license must be at least Class 4 and above I believe...

 

He is more than willing to settle privately with you because the penalty for failing to ensure his rear is clear before reversing his 3 footer lorry is quite heavy if you were to report him to TP.

 

His is a tan chia license thus he is at losing end if you report him.

 

I'll suggest both of you agree on a neutral bike shop to do the damage cost assessment and have the driver to bear the total bill plus any injury treatment cost.

Thnx man,i tink the lorry needs class 3 only.Initially he did mention abt reporting to the Police abt it and claim insurance but i noe if report Police,sure he die one.And yes failure to check for traffic/pedestrian sure carry heavy penalty.i believe he clutch in his gears during that period not realising he's on a gradual slope.Lucky for him dat i was able to hold on to my bike with my wife at the back,if not,he'll be eating porridge.Will go down to the motordiam for assessment on the damage.Thnx man.

Go and report IDAC before 4.30 tomorrow (report must be made within 24hrs of accident), let the fella at IDAC take pics of your bike but tell them you are not claiming YET. Do this so that you have a report in case he decides to back out.

 

If he is willing to pay, good. But my experience is that SOME will probably dispute the amount, then try to bargain or not pay at all and ask you to claim from their insurance, and while you're claiming against them, they will make a claim as you as well and try to deny liability. They can say you came up and hit them from behind. Believe me, there are many people out there like this.

 

Remember: Any agreement both of you decides on, have it in black and white.
