I returned to my bike to find the right mirror out from the normal place, to my horor , after i checked, my entire right ride KENA dmged . haiz end can.. right fairing all kena... turned out i was hit by a taxi and he picked my bike up after knocking it down and just drove away. NOW HOW? i went make police report le, tried calling insurance company but they are 9-530. haiz ******* taxi uncle. when i asked him come see my bike dmges he say he busy cannot.. tml then contact me see how

Wah, Palmer, your case still not resolved? Can we have an example of the official stance of the police in this situation? Do you having it in writing? If not, I think everyone would buy that company's insurance and don't report any accident. There is a conflict of interest when the party who stands to lose (his insurance company), is responsible for making him lodge a report. The police needs to take action.

still not resolved. In fact i gave him one last chance on Weds night when i bumped into him at Simpang Bedok with some other bikers. When approached, he casually said (lao lan style) "GO TO COURT LOR!"

As much as he is the problem, I think the bigger problem lies with the conflict of interest of having his insurance company pursue him for a report. Both he and his insurance company stand to gain if they act blur.

 

"Motorists are advised to report the accident to their insurers as soon as possible. If one of the drivers does not report to his insurer and the latter comes to know of a claim by the other party involved in the accident, the insurer has to contact the insured and request him to lodge a report. If the assured still refuses to lodge a report with the insurance company, the matter will be referred to the police."

 

It appears that the police is a last resort for this situation, but it is unclear whether the insurance company or you should be the one pushing the police to take action. As mentioned above, the insurance company stands to lose if the guy files a report. So I believe that you must ask the police to step in.

 

I am really interested in the position of the SPF in this regard, because there is a legal loophole here with this conflict of interest. If the insurance company does not stand to lose MORE by avoid their legal responsibility, then they will all be unwilling to pursue their clients for accident reports.
