abt accident

after some thinking ...

i come out with a senerio that ...

One day while riding ..

infront was a traffic junction .. the lights turn red ...

u are far away from the traffic lights... den i inside ur lane ..

suddenly a car A turn out to ur lane ....

 

1. You go straight ... and hit the car A ... u can claim the car A ... as the car A is at fault ...

 

but ...

 

2. u think of avoiding the carA ... u siam .... but bang to another car B ...

or u jam brake and try to siam .. but bang car B ..

 

my problem is .. since u not hitting the one who is at fault ... but hitting the other ppl ...

how will this situation be resolve...

 

U hit the person.. den the person claim u ??

Or since is not ur fault is the car A turn out ... and is the carA fault .. the car B should claim from car A ????

 

so how should this go about ...

 

if car B should be claiming u ... i think its worth to bang car A.

Hi intersting but common scenario.

 

The point is, which car u have accident with, car A or car B?

 

In this case it is obviously car B, so any claims shd be between u and car B.

 

Ur last statement is absolutely correct, in theory at least, since by avoiding car A, u hit car B and car B claim u, then it is better to hit car A.

 

But in practice, I would try my best not to hit anybody. If I drive a car, I'll "try" to hit" whichever vehicle caused the trouble", in this case car A, I'll not hesitate to hit car A, and even though the case may be 50-50, at least car A is "punished" in a way that he has to make time for insurance, for TP investigation, for time lost, he shall learn his lesson, next time better check blind spot ad drive carefully.

 

Car B is not the "trouble starter" so I'll leave him alone.

 

But when I ride, I'll take care of myself first, I'll try to avoid a collision in whatever cause, becasue it is my life, I might not survive the collision with car A, let alone to "punish" him!

if say u travelling in between cars , den suddenly a car turns and u bang it side , who sala?

think about this.. u bang car a from behind..u fly to tjhe front..can cause head injury and even deat.. u bang car b from side..knock from side and will skid and roll..but high probability wont die..

normally under the perfect scenario, we will like to picture that we hit the vehicle which is wrong so we can claim from him/her. But as we are all human, we are armed with this "Human Reflex" thing. When you are driving or riding and suddenly something happen in front of you, you first reaction is to siam with all the might you can. This is human reflex.

 

So although we all like to "punish" the vehicle which is in wrong, usually our reflex will take over our that instant reaction
