I get into an accident last saturday (29/01/2011). I was at a traffic light (stopped) as it was a red light when this car hit us (me & wife) from the back.. The driver was drunk as i can tell from the strong alcohol smell from his mouth.. The impact was so hard till i and my wife flew off from my bike about 15m... Luckily we were not seriously injured but my bike is seriously damaged.. I called the police.. they came and do the alcohol test on the driver and he failed the test.

 

The thing is, how to claim from the driver for my bike damaged as i only knew dat the insurance company won't cover a drunk person. Can i get a lawyer to fight for my case to claim my bike damaged and my medical fees, mc...?

Means we can make him pay for the bike damaged right...? and i'm confident i can win the case coz it's obviously nt my fault and i have witness too... the only thing dat i'm not sure about is the claim thing..

Speak to a lawyer who has good experience in personal injuries and motor accident claims.

 

Note: You can claim against the insurer of a drunk driver for bodily injury only. The insurer cannot deny a claim for injury if the driver is drunk. But for property damage, the insurer will not pay, and you will need to claim this part against the driver personally.

if u want to save the hassle, go to a workshop whom can settle all tat (e.g. bike repair, insurance/medical claim thru lawyer), the mechanic can settle tat for u, but they take in some commision lah, ( in any case u dun need to pay any since it is clear cut nt ur fault)
