i recently got a letter from a lawyer firm stating claims against me, the accident happened on oct 2010. So i called my insurance agency allianz, to check up on the situation and they said that they will not cover for me. reason being i did not report the accident directly to them. i seriously thought making a police report is sufficient. Now they say i have to pay the claims myself.

 

has anyone been through this type of situation or know anything. Please give me some solution or advise cause i cannot afford the claims cost.

Can you give us more insight into the accident? The circumstances and what were the actions taken by both parties?

 

it was an accident involving me and a Malaysian motorcycle at BKE. I clipped him a bit by the side and he fell of his bike. i personally send him to the hospital after that and made a police report when i got home cause he wants to claim insurance. So i thought that was enough on my part to be covered but apparently not according to the insurance company. i wish ive known what to do because ive never been involved in an accident before. can anyone tell me what my options are, advices etc

I think for now, you can ask them to show you the term and condition stating the need to report to them in the event of accident. If it really stated there, I think you have to suck thumb. Police won't be able to help you.

 

This bring up another question. If I were to report to IDAC within 48hours, will it consider reported to insurance company? Cause if I am the TS, I will only go IDAC since other party claiming me and not I claim other party.

Yes, my understanding is IDAC will file to the insurance company for u.

i find this extremely odd.

 

is this to say that if i were an accident victim, and the guilty motorist does not report the accident, his insurance company will tell me suck thumb and sort it out privately myself? and then if the guilty party disappears or refuse to pay claiming innocence or claiming no money, i must then bring it up to court myself? then we all just dont report so escape liability lor.

 

regards to reporting, you must find out from your insurance company where are their official reporting centers. when i made my report last time, it was a 'third party' reporting center somewhere in toh guan which served several different insurance companies. i dont know if IDAC itself serves as such a reporting center, but even if it does, it needs to directly serve your insurance company. always always always call your insurance company within 24h to ask what you need to do when involved in accident.

Based on the facts that you have provided, you're liable to foot the repair costs and other whatnots claimed by the other party as you have failed to inform your insurer within the stipulated time after the accident. Take this as a learning point.
