Hi all,

 

It's quite urgent and kinda special case.

 

Can i transfer the bike's ownership to my name if it is left behind by my lated bro? No will made.

 

My bro is married less than 1/2yr but tragedy happened between the couple. I lost my brother.

Our terms with his wife aint gd cos she is the culprit for everything happened.

 

Right now, my main concern is just to keep the bike as memorance. i've promised my brother that i'll let his bike to be on road again. When he is still ard, he did wanna give his bike to me... I just want to fulfil his wish.

 

I've tried asking ard like LTA or Public Trustee... but they cant seems to help me... I need help urgently... The government is gonna take back the bike soon... I need to do something to it..

 

Please help..

No you can't. If your brother dies intestate, then his estate goes to the spouse (and children, if any). And I don't really understand what you mean by the government taking the bike back.

you will need to get the administrator of your brother's estate to transfer the bike to you. if your brother's spouse is not interested at all, and hasn't applied for administration of the estate, then you (or any other eligible person) can go and do so. only the owner can transfer the bike, and if the owner is dead, then the bike forms part of his estate, and the only people who can deal with his estate are the administrators of the estate - if you want the bike transferred, i would imagine LTA's going to want the transfer form signed by someone with the authority to deal with the bike.

Ok...I take it that your bro left quite some time ago, and all the authorities has registered his status in their computer records. So there is no way to do the transfer at the LTA counter anymore!

 

Well....the HALF-LEGAL way your can do it to report to the police the bike is stolen.

Don't worry, the police will not go around looking for a cheap bike. The estate management will also just take note and can not do much about such 'theft/lost'

 

Then keep the bike in your 'special' museum out of sight of the wife and authorities.

 

Legally....well you have to let the law takes its course..indicate to the estate management that you have a share in the claim of the bike(say your help to pay for its installment or purchase price.etc).....it may take a few years. But in the end you will get the bike legally registered in your name.

Don't worry, they won't sell off the bike or scrape it without giving it to the wife or you.

I think you may have to bite your pride and talk to the wife about the bike, I am sure if you talk with reason...she will relent.

that would have been easy if the wife is easy to tok to... the problem now is that the wife is a b***h and is intent on making life difficult for her family...

 

they actually made the claims... but her family forgot to add in the bike... so now the bike is dangling in the air and the spouse do not want it... so she is still looking into more ways to put the bike on the road...

she is indeed a ######... she wan something back from us to exchange for the bike... we did talk to her nicely but she is ###### demanding as if our family owe her alot.. im not sure what's she thinking..

 

meanwhile.. i have reapplied for the lay-up so i can prolong the bike till jan2008... but i cant lay up more than 3yrs else it must be scrapped or permanently exported... this yr will be the sec yr.. not much time left... thats y i'm panicked...

 

i've approached the public trustee but they are not handling it cos lawyer is involved.... LTA talks about document... my last resort is to approach the MP... i wonder is it workable or am i jus wasting my time...

 

sigh..

 

the lawyer actually did suggested one solution which is to apply the grant thru the government which costs me 5 to 10k... i dun have such money... and the valuation of the bike is only $250...

 

sigh...

 

no way out liao...

Estate administration and distribution is already a complex matter. A lot of info is needed to determine how each case would go - for example, whether the deceased was a Muslim an thu subject to Syariah law or else the succession is subject to civil law, who the surviving proper claimants to the estate are, whether the estate could be administered by the Public Trustee, and a lot more.

 

You should have consulted a professional who knows how to advise you on your situation - but instead you chose to guess and complain.

 

You have what seems to be the easy way out of this situation and you refused - buying it from the proper beneficiary, the widow. Get this - it's her property and she can do what she likes with it. Nothing you say or do will change this. So you could choose to accept the reality of your situation and buy over the bike, or leave it.

its not i dun wan to buy from her or whatsoever... she refuse to talk to us but only demanding something else back which its impossible to do so.. i cant do anything... and i have already consulted my lawyer... she said the only alternative is to apply for grant... which is beyond my means... the wife wants my elder bro to apologise or rather explain to her for something else but the point is my family totally don not wish to have anything to do with her... what else can i do??? im struck in between...

 

im not guessing or complaining but askin for another solution instead of gg thru the grant...

 

maybe the alternative is gg thru the MP...

hi ..

 

i'm not too sure if going to MP would help. wat needs to be done if i'm not wrong, apply a probate letter from ur lawyer to make a claim on the bike. even if the case is closed, if there is still a property (eg. a bike ) that is left behind .. you can still make a claim again. Use the same reference number as the previous claim. The probate letter, procedures and such would costs roughly abot $3K upwards .. i'm not too sure coz i have done it for my late father's car. Your lawyer would be able to assist you to apply for that probate letter.

The MP can at best influence matters of policy - which would be like how the government administers its programmes, matters of applying procedure, rules or enforcement.

hanzer, i am sorry this happened, and i am sorry for what I am going to type.

 

Let the bike go. Its your sister-in-law's property now. Let her handle the consequences & whatever it was for the bike.

 

Your late brother surely would not want to know you are so unhappy about the tussle for the bike, or that the whole event is being dragged around thru the mud as it had done now. And I am sure everyone in the family is terribly angry and upset about the issues too.

 

So let it go, I am sure he will be more grateful for peace and your family remembering him well, instead of frustrating over a non-living thing aka bike.

 

Someone will have to sell the bike, talk to the lawyer to buy it? Not directly from your sisterinlaw, but maybe to buy it from his estate?

 

Ting, can that be done? Please advise.

she cant be bothered with the bike.. its parked at my house downstair for nearly 1yr... i doubt she knows anything about the bike too cos every document are send to my house...

 

to let go the bike?? i hope i can.. but before they scrap the bike im willing to give it a try unless the day comes..

Dun do anything illegal by getting a small bike then change the chasis no., engine no., reg plate etc...
