anyway, my friend decided to let the matter rest. maybe because he ask his other friends and they also said that he should be thankful the pedestrian was willing to pay half. he didn't have any serious injury and his bike wasn't badly damaged so i guess he can just take this as experience

but should still be careful cos the other party have up to 3 years to claim injuries and medical..

 

Yes try if you want maybe can sign black n white..Saying that the other party or yourself, cannot claim from eachother in the future..

There seems to be a sense of disliking pedestrians... but weren't we all like that before we got our bikes? And if we sway and hit the fella, we can be angry at the person, but if it's an old person or someone we know, what happends to guilt? Even though they may be in the wrong, but it takes 2 hands to clap.

i don't really agreed on "failing to keep a proper lookout" when that happen.

some pedestrians are really dumb. like suddenly cross the road when the traffic light is green. then what the use of pedestrian crossing?

 

eg, if a fellow crossing MRT track and got bang by the train. who at fault? the MRT driver or the fellow who cross the track?

 

Yes, some road users are really dumb. But the duty of a motorist is to keep a proper lookout, including for dumb road users, for obstacles on the road and all kinds of unexpected things too.

 

For example, at a junction where you should expect to proceed straight ahead, you would still need to keep a lookout for pedestrians, turning vehicles, vehicles going the wrong direction, obstacles, obstructions, whatever...

Yes what you say is true..Anyway accidents do happen,we are human......not perfect...All depends on luck..for my case.Its fate,just have to accept it... :cry:
