yeah. they have a clause stating that you have to report all potential (or not) claims. In the event you do not report it, they have the right to refuse a claim if the TP comes after you

problem is.... Im insured under AIG, whether Allianz has that clause or not, the other motorists wont know. It is unfair to whoever is making the claim against the Allianz policy holder.

All the fine prints are inside the policy contract (which nobody reads)

So the insurance companies can always turn around and say

"I've already given you the policy contract. Everything is in there..."

people won't read the contract until something happens...

I don't even read my policy contract.... I only came to know about this clause from Allianz when one of my friend told me about it (when i kissed a grandis backside)

in that case everyone should stick a sticker stating which insurance company the vehicle is insured with. Then we know which vehicles to stay far away from and not to have accident with. :dozed:

EDIT: Found the office address already.

Why don't you call up Allianz and check? Tell them that you've been waiting since September 2007, and that if you don't receive your refund by 31/01/08, you'll write in to MAS

actually, i think if there's a third party claim, allianz cannot reject the claim. Allianz will have to pay for the Third Party's damages and subsequently claim back (from their own insured) whatever they've paid to you...

It is not clear:

1. What claims are you making against the other party?

2. What is this legal company that you claim represents you?

1. Claiming for my vehicle damage when the other party knocked into my vehicle.

2. Lawyer firm.

It is a 3rd party claim against their policyholder. I'm not the one insured under Allianz.

Since you have a law firm representing you, ask them to advise you.

In my view, the usual way that insurers deal with such a third party claim is to ask their insured for his version of events. If the insured has denied the event took place, then the insurer would give you the response that your claim is not going ahead because our insured denies it. You then have to prove your case. You could also sue the other party directly instead of his insurer.

On the other hand, if it is the case of the insured not reporting the claim, the insurer should typically take these steps:

If an insurance company is aware that its insured has failed to report an accident to the company, it would send a registered letter to the insured, requesting him to report the accident, failing which the police will be informed.

Police will then write to the insured to advise him to report the accident to the insurance company without any more delay.

If the insured still does not report the accident after a second reminder by the insurance company, the case would be referred to the police for investigations.

He who hesitates is lost!
