It has been standard practice in the US for force an alcohol test, otherwise you lose your license. Lately however, several cases have been won because in the US you have a right of presumed innocence and you have a right not to incriminate yourself. Forcing an alcohol test abridges your right to not incriminate yourself.

if i m not wrong... under the law.. if been stop for drink n drive.. we will have to provide either blood test or breath test... if both don give... they still can proceed to charge us....

this is singapore... they really control the level of alcohol in yr body very strict...

But it is totally another thing to get pulled over for erratic/unsafe riding... if you have drunk enough to grab the attention of the police you probably deserve to get pulled over.

aiya... think on the postive side... if u don't drink.. then y have the guilt?

there is once...my fren drank and drive....

 

den kena stop...but his breath test pass...den the TP very cocky, ask him to breath again, try many time until he fail.

 

no choice, go police station. End up only warning, nothing happen cuz he drink only a little...

hmmmm... help ? my frend tio drink driving last week. juz 2 glasses of burbon. his reading is 43 mg. passing is 35 below. 100% without doing anything his lic. will be suspended for 1 year (12mths) in court. thats mean he gotta take all his RTT + prac all over again. am i rite ?

what if he consult a lawyer ? do u guys think he have higher chances of getting away ? :confused:

Tell u wad. If ur frd consult a lawyer and he got free....

U might received tons of pms mails inquiring the lawyers ctc n fees !

heya..

i dig this thread to get some info on drink driving..

 

my fren was caught last 2 mths.. he regret and learn his lesson.

 

just now met him.. pity him.. work so hard to pay up the fine by installment. we chat for a while..he ask me whether he can write an appeal to reduce his sentence.

 

he was charged $3500 fine and 2 years revoke. he wonder why so much. his offence.. 53mg of acl.. fail to display pplate. BUT it was his 1st time caught fail to display pplate.

 

he told me actually judge sentence him $2000 for drink driving $1500 for fail to display pplate. and judge straight away sentence 2 years revoke. didnt mention 2 years revoke for which charge. he was numb to ask for liency at that time.

 

he ask me give him sample how to write an appeal. he just hope to reduce his revocation period for 1 year instead of 2 years cos it was his 1st time caught fail to display pplate which 1st time offender fine $120. he dun mind paying the $3500 fine.

 

someone help give suggestion.

Now the SG law is that if you are caught drink driving your license will immediately be revoked. They are stepping up hard to drink driving. My fren is lucky the other time his breath analysis is below the limit by 1/2 and the TP let him off. But now i think it's a bit hard cos a bit only they will ask you do further test.

 

Best is not drink and drive.

Maybe your friend can volunteer for community service in exchange for a reduced sentence? No idea if it works but no harm trying. Of course, need to verify with the relevant authorities first.

Sorry , IMO anyone who dirnks and then drives or ride desrve to die not only he endanger himself he endanger others.

Drink-driving is a really serious offense.

 

If you drink, don't drive. Take a cab.

The thing is that , under the law , you can be convicted of drink and driving and prosecuted for as long as there's presence of alcohol in your breath/blood and if the police officer deem you unfit for riding . What if the police officer personally disapproves of any person(s) who drinks? He'll just say , you're unfit to ride !

Hi, my friend was caught for drink riding last week. Anyone can advice on the penalty and will his license get revoked or will it just get suspended? Anyone knoqa how long it will take before the court date? Also has anyone tried to appeal before?

 

Appeal?? He should have been banned for life!

i asked few ppl caught drink driving.. mostly regret and learn their lesson.. becos the fine was too heavy..

 

at least give 2nd chance to take license again..

but he told me other convicts got not more than 18 mths but higher fine..somemore their ach level higher than his. my fren prefer to be that way..pay more fine.. less revoke period..

Well, your friend should thank any god he prays to that no one was injured or, worse, killed when he was drink riding/driving. The fine and sentence is nothing compared to the guilt of causing the death of another.
