Dear Folk and friend,

 

The summary of the story is I loan $650 to a ex-Security Supervisor. I had been transferred of the workplace and he has resigned from the work place.

 

We had gone out drinking a few times. He promised to return me after I called. Recently, he was uncontactable through phone. I have no other means to contact him. However, I think I am able to find his IC no. and I have the records of transaction (his bank account No.) and his msg when i transfer the money.

 

How can i claim my loan from this *******. Any chance to claim back through Small claims?

Get his details, go to his house... Ask for your money back,.... If he not home, tell whoever in his house that he owes u money

the result of going small claims is that they will give a letter stating that the person owes you so much.. if he got nothing to pay you back also no use..

correct me if i am wrong.. cos i have the similiar issue as well..

Rat bike - A motorcycle not necessarily kept in pristine condition, often painted matt black. Minimal maintenance and mismatched parts often used.

ur case probably does not fall under the jurisdiction of the Small Claims Tribunal. go read the SCT website for more info...

 

Small Claims Tribunal

 

a. If your matter comes within the jurisdiction of the Small Claims Tribunals (SCT), you may choose to lodge a claim through SCT. SCT is situated at the ground floor of Subordinate Courts.

 

b. SCT’s jurisdiction generally covers civil cases of the following nature:

Claims arising from a contract for the Sale of Goods3

Claims arising from a contract for the Provision of Services4 and

Claims in tort arising from damage caused to property5 (except those caused by a motor vehicle)

Claims arising from any contract for the lease of residential premises that do not exceed 2 years

 

c. Your would also need to note:

that the claim amount must not exceed S$20,000/-, and for claims beyond S$10,000 but not exceeding S$20,000 both parties must consent in writing before the Registrar / Assistant Registrar.

the claim must also be lodged within one year from the date when the cause of action accrued6.

 

d. Please note that the claims which do not come under the jurisdiction of the SCT include the following:

hire purchase agreements

employment matters

personal loans

stock and shares

foreign exchange (forex)

rental of chattels (such as movable goods, car rentals, video tape rentals and machinery rentals)

rental (commercial or industrial premises)

legal fees

co-broking

time-share claims

insurance claims

 

e. For more information you may wish to enquire at SCT, or access their website at http://www.smallclaims.gov.sg

 

3An agreement to transfer ownership of movable property in return for money

4 An agreement to provide a service which includes labour and skill in return for money

5 Damages to property includes loss and expense incurred as a result for a careless, reckless or improper act.
