just curious, i've been thinking abt this.

If u happen to go out with your bike, chill with friends,

friends started to drink, yet u also drink.

 

but then, after the day ends, you PUSH your bike home.

 

What if Police, Traffic Police or ROV catch u ?

 

consider drink driving ? or ?

i'll be your competition..

If you are drunk and resting in the driver seat, even with engine OFF, you would have committed the offence of being in charge of motor car whilst under the influence of drink under Sec 68(1)(b) [Road Traffic Act] Cap 276.

oh.. i read abt an article think early last year. regarding abt it.

How to push bike if drunk? I think you push the bike later, slowly but surely, you will find yourself in the right extreme lane hahaha. Sure TP will catch and put you in Hotel Heartbreak. Bike I think they leave on the pavement. Then later TP came and put letter for you to pay them hahahha.

Section 68(1)(b) punishes being "in charge of" a vehicle, which is not defined in the legislation. Whether one is guilty turns on the court's interpretation of this phrase. The CJ said in the case linked above (PP v Chong Pit Khai) that he thinks the section is directed at the risk of harm from a person not fit to drive, not a harmless activity. He also did say that he did not think the appellant was guilty of the first offence, but he could not change that because he had already pleaded guilty.

 

What this means is that sleeping in the car while drunk is NOT likely to be considered drink driving, but it depends on the facts. For example there was another driver who was caught sleeping in a lorry by the side of the expressway and was convicted, in this case because it was probable that he drove before stopping. So the main thing is that the accused must be able to prove that he did not drive and was not about to drive. Factors probably include where he was sitting (back seat is better), engine on or off, where the vehicle is parked (proper car park is useful).

 

Back to TS question on pushing bike - it is probably an offence, because you are clearly in charge of your vehicle if you're pushing it. So don't try.

 

My question is, why would you want to push your bike? I definitely wouldn't! Insanely tiring, even if its 2B bike. Just take a cab or public.

wow... that's something to think about

even when sober, sometimes on some days i just feel like "dun wanna push" so i sit and use leg power!!!

 

when drunk already... how to push? legalities aside, won't the risk of dropping it be very high?

hmmm.. sometimes, u drink abit, but then u think u're not drunk, but play safe, u push your bike.. its not like u totally drunk, like drunken master like that la.. of course u cannot push your bike for sure.. LOL!

31 Section 68(1) does not define the meaning of the words “being in charge of”. That phrase implies the ability to control or having the power to do something with the motor vehicle, such as to drive it somewhere. The offender should at least have some degree of physical ability to do any of these things by himself. It is difficult to envisage a person being in charge of a vehicle if he is simply sleeping in it, especially when the vehicle is properly parked in a designated parking lot. Nevertheless, in PP v Oh Yin Yan Ronnie [2007] SGDC 35, it was held that a driver found sleeping in a lorry along an expressway was still in charge of the lorry. In that case, it could reasonably be inferred that the driver had driven the lorry before stopping. Otherwise, it could not have been on the shoulder of an expressway. But, the same inference could not necessarily be made in the case of the appellant with respect to the s 68 offence.

 

I'm not contesting you on this one, but I must say, it's an interesting case you have there, Demon ;)

tp has the ability to check on u if u had drink riding even after u rode ur bike home n he stop u below with ur engine off & rider not on bike.. =)

the best possible solution is to learn to say "NO"

if you know you're riding / driving, just say no

and if your friends force you to drink, you better start thinking about who your friends are

 

and if you wanna have a drink, then leave your ride at home...

use it at the right times of coz

 

before this recession, i used to bring foreign colleagues out for seafood dinner at east coast seafood ctr, and of course there would be beer and wine

 

but i never agreed to let anyone force me to drink. not even a sip

coz i told them straight that i'm riding so won't take the risk at all

 

furthermore it is still a company function and imagine the consequences if i was caught drink riding... lose license, lose job (due to company's drug / alco policies) and if suay, lose life...
