yup you are at losing end because you hit him from behind no matter the circumstances. the back person always loses.

shd have take picture evidence at the scene using your GF's phone. not much you can do now except to report to your own insurer about the accident and hope for the best. no need to make a police report.

I understand how you felt at the point of the accident. Unsure of what to do, whether to trust the other party's words, etc. But since you didnt take a pic of your own, then the car driver is at an advantage.

You should go to your insurer's assigned accident damage assessment centre asap as they will also take pictures of your bike as part of your report. If there is little damage on your bike, then the car driver cannot claim that you caused his big dent on his bumper.

But you must report asap too, otherwise the car driver can argue that you replaced your sent your bike for repairs, etc.

Simply put, if you havent gone to IDAC asap, then the guy can make up 1001 stories on how you knowcked his bumper. He has your IC no., bike no., hp no. and pictures. Making a report at IDAC is basically to cover your ass as much as possible.

Nobody will call you anymore cos the case is likely being handled by the insurance company(s). Just expect your insurance premium to shoot up the next time you renew. You switch insurance companies also no use, as accident claims are all centralized. ie, once someone makes a claim against you and is paid by your insurer, all the other companies will know about it.

agree with strobe.

had a smiliar case when i hit a ah neh's super4 box and he cocked up alot of stories. its safer to report to IDAC asap, not needed to report to police since no injuries. But u're at a losing end cause u didnt take photo at scene of accident.

and...

if ur insurance havent been claim before, u can call up the driver and settle with private settlement; bumper scratched prolly repaint cost u about 100bucks? and tell idac its privately settled. if not ur premium next will shoot up.

but that is if driver agree and sign private settlement form. if not, then no choice let insurance company handle lo. they will keep sending you letters regarding the the accident claim though. about 2 - 5 letters received for me.

But will the idac contact or insurance company contact me if a report is being filed? coz that guy only got my contact number n my bike plate number

That is enough to make a report to his insurance company. As for you, if you did not make a report, your insurance company may reject the claims and in the end all cost bear by you. Worst case scenario that is.

i am a mindef personnel, no camera fone so didnt take any. But Gf as a pillion said she saw the can suddenly break b4 i slightly knock onto his back bumber.

if the car brake suddenly and you hit it, you have failed to keep a safe riding distance

last year just claim over 1k plus from a taxi driver who failed to keep safe driving distance.

but i have not received any letter yet

hey pal..honestly theres really nothing much u can do if u dun hv any pics, driver's contact details n personal particulars.the only advice is: ride safe in future n NEVER TAILGATE.maintain a safe distance of at least a car length away.sum drivers like to brake intermittently or jam brake n the consequences can be dire.so keep yr fingers crossed n wish u the best of luck...

normally car will not claim, cos they have to go drive to idac, waste 1 hour there.. then go workshop see the quotation, 1 hour again. go home then sit down inform insurance. then finally have to wait wait wait wait and wait up to min 1 n half year just for that few hundred...

and our insurance will send a letter to him,

Dear Mr Foolish,

we act for our client MR BIKE regarding the accident involved on the 01/01/10.

DUE TO OUR (INVESTIGATION), my client was travelling in a safe speed and a safe distance.therefore the accident could have been avoided if you had not jam brake abrutly.

HOWEVER, we are willing to accept 25% of your claim.otherwise you may choose to seek further legal consulting.

so end of the day, its nto fair to him so in the first place he won be bothered to make a claim... but all this is only my pure opinion.. been involved with accident alot of time and figured out that insurance claim are smelly. its the fact

like my wife for instance..she was involved ina accident last time, she was riding back home and the lorry just dash out without checking, she suffered 15 stich and a fracture hand,

my dear motorshop offer to repair her bike first without paying but he will take 10% of the claim, my lawyer also taking 30%.

the bike was repair but in a horrible condition(all second parts)claiming $2000

its has been 1 year and i am still waiting for my claim..

so now my wife are left with

*a horrible wave which she sold back to the motorshop

*wait wait wait

*total claiming $5000-shop$500-lawyer$1500 so i am only left with $4000

but her hospital bill 1k plus, loss of income..
