Hi all,

I have brought a lemon bike with a nice number plate and sell it in 2 weeks.

I have a verbal agreement with the bike shop for retaining the number plate if the shop managed to find a buyer for the plate. I have told the new owner with regard to the number plate, he agreed, but after selling the bike to him, he seem to be reluctance to part with the plate.

 

The bike shop just called me, he would find me if the new onwer did not want to part with the plate and shop is asking 1.5k for the number.

 

Is it a case if the bike shop insist for the plate as I am not the new owner now?

 

Can the shop take legal action against me? Currently no blank and white...maybe some sms with words like agreement on it...But nothing had been said about the number plate...Only msg like " yes I have told the new owner of the agreement" or something like that...;

Pls advice? thks

huh, catch no ball. shop call you and say cannot find you if sale cannot go through? whatcha mean? new owner don't want to buy the bike without plate? shop don't wanna buy bike without plate? "he" = shop or "he" = new owner?. shop asking you to pay 1.5k if you want to retain plate? shop is asking new owner 1.5k for plate? new owner asking you whether you want to sell the plate for 1.5k?

 

i might be a bit rusty, but if my memory serves me right, verbal agreement is a legally binding contract. the problem is how to prove that there was an agreement in the first place. if just you and the shop owner, then problem. he-say-i-say-fight-no-end. if got neutral 3rd party, then, settle, can get the 3rd party to come be witness if shop wanna argue.

 

party who has interest in the outcome, not counted if i'm not wrong. e.g., your friend, or the shop's worker, if they stand to benefit, then also cannot be neutral 3rd party. e.g., shop mechanic say he heard blah blah blah, you can argue that the mechanic is saying that because he is employee and indirectly benefit from the sale (if he don't agree, boss will fire him). likewise, if you get your friend, shop can argue ya'll in cahoots. so, debatable.

 

like i said, my memory's rusty. one of the core mods i took. please feel free to correct if my understanding is wrong.

 

ps: wait for the legal eagles to come in here and advise you. there are a few around here with pretty good info.

eehhhhhhh, still don't get it. you might wanna rephrase again.what kinda deal do you have with the shop? agreement with the shop to retain the number plate if the shop can find a buyer for the plate? huh? like that, is want to retain or don't want to retain? and the shop is asking you for 1.5k for the number? or the shop is asking the new owner for 1.5k? in that case, what do you want from the shop?

 

what kinda of legal action can they take against you, if they have the number, and the bike legally belongs to them?

 

in any case, like above mentioned, if there's some other neutral 3rd party hanging around and heard the agreement, then it's easier to argue your case. if just you and the shop owner, it's your-word-vs-my-word, fight until cow come home.

If there is no written agreement between you and the bike shop on the number plate, the plate should be legally yours. The log card say the number plate and the bike is register to your name. So I think you have the upper hand now.

Contract can be made through verbal agreement. If there is consideration (benefit like $), it is a legal contract. What puzzled me is how come the shop release the log card without ensuring that you pay them for the number plate. They must have know you well and trusted you to do the right thing...

anyway, i miss wildcard.

In fact no. made me spend more than 1/2 the price of the bike to repair it...Leave me on the road once I decide to sell it off. Wanna refund insurance made me go to his shop sign authorization letter and then tell me " Do me a favor go to the agent" Make me run like a fool.

Agent said refund credit back to them....

Haiz....Still have to go back see that face..

I will return the favor....Want number plate " do me a favour talk to new owner" simple....

2) u sell bike to A, but w/o 'NICE' plate.

3) now A seems like he doesn't want to 'RETURN' the plae to the shop.

 

Just give A's contact no to the shop, & let them settle between themseleves.

Trust mi, there's nothing the shop can do to u.

He got ur adddress ? He finds u , but what can he do to u if bike sold aready with the Nice plate on it.:dot:
