Hi guys.

 

The accident

I had an accident on 09/05/2010. I was stationary and got banged by a company van with a PRC driver turning right. He was sharing a lane with me. He wanted to beat the oncoming traffic to turn right and didnt check his blindspot and forgot i was there. There was an unknown woman in the van. I flew off my bike, did a side almost 360 degree spin, and landed on my left shoulder. My bike was dragged under its right wheel for about a metre.

 

I got up, barely had any injuries, picked up my bike and pushed it to the side and started to kick start it. The driver went to complete his right turn and parked it near me. Once i got my bike to start, i ask him, my bike like this "HOW?" and showed him my injuries. He insisted that he turned on his signal and did the right turn. But i argued that he banged into me and you signal doesn't mean you can anyhow turn and bang into me. He almost couldn't speak a word of english.

 

I was in a hurry and got so pissed that i just wanted to leave him. He then ask me to follow him to look at the damages at his van. Barely any damage when my bike's fairing was scratched, my gear shift lever bent here and there etc. He insisted that i pay for the damages done to his van.

 

So fine then, exchanged particulars then i inspected my bike and his vehicle, took pictures, just in case he smash his van and come up with some c0ck and bull story.

 

I then rushed to A&E at SGH as i was feeling shoulder and lower back pain and was given 3 days LD. Don't ask my why the doctor gave me LD i also don't know. I have to admit i was barely injured, only a few bruises and scrapes. I think the reason why i was not so injured was that i was stationary and if i were moving, confirm i kenna dragged together with my bike under the van's wheel.

 

Just so you guys know, i had no witnesses, no accident scene photos and no police report. My bike is under 3rd party NTUC insurance. My bike is fully working, engine still running and it has always been with me.

 

Roughly you guys think what is the chances of me winning? Thanks.

u stop beside him during the right turn is it? if u stop beside him of cos is your fault la. By right we squeeze in between car is our fault already, there are not at fault if they bang you. If your case is you r infront of the van n the van go bang you becos he need to turn right den is his fault.

I was there first, then he squeeze beside me.

 

Anyone here can share their experiences when they made a claim against someone's insurer and lost? Roughly how much do the lawyers fees cost? My bike insurance is 3rd party and i scared if lose come out from my own pocket.

To protect yourself, inform NTUC income first. Then ask for their advice. This is what your insurance are for.

 

3rd party insurance cover you when you are wrong, so don't worry about your pocket, unless you do not have valid licence, or drink & ride. (I believe this is not the case)

 

If you don't tell NTUC income early, then you are respondable. If you tell them early, just prepared for increase in premium next time, if you are wrong.

 

Their hotline is 24/7, so call them now. Only they can give you the best advice.

I just called them about 2 hours ago. They said that i only got 3rd party, so it doesnt involve them at all. The thing is that, when i make a claim against the other party and if i lose, i am afraid that the charges of my bike shop lawyer and the other party lawyer will be sky high and i will have to pay them for the legal fees, in addition to the repairs of my bike.

The previous day i was at the gym and like what my friend told me, luckily i was doing bicep/tricep/shoulder exercises. I think it really protected my shoulder from getting seriously injured the day of the accident. Come to think of it, i am lucky to be flung off and escape from minor injuries. I could been have dragged along with my bike.

if ur bikeshop is not a black shop y not speak to them???

 

 

most ppl have wrote in forum before, if shop know can be claim most probably they will bear the cost. its more like they know the claiming they do can get back in return if not u pay at most is dmg. but for lawyer to be activated y not ask ur shop the charges?

 

 

i think u need to worry the van claiming u too.

 

cos at worse u pay ur own repair unless it heavily damage if u were not to get claim, but he claim u sure u bo hua.

You should have laid down and wait for an ambulance. You'll never know what internal injuries you may have sustained. Don't move the bike and ask the fella not to move his van.

 

Plus, once you're conveyed, it becomes a TP case. Based on the scenario you explained to me, the driver is screwed. Even though the outcome of the TP investigation "supposedly" has no bearing on the claim, there is somewhat a degree of persuasiveness if TP rules in your favour. You might get a 70-90% claim.

hard lar... I also got into a accident be4 and i claim the other party 20+K.

First thing first, u got no witness. So you say your story and he say his story.

No proof. Hard to win. Everything in the eyes of the law need proof.

 

I won the claim because the other party admit it's his fault when he report to idac.

So for your case, i think u should forget it. (not trying to pour cold water)

bro, u have 3 days mc means u should go make police report.

So can claim more against the other party.

U may want to extend mc as well.

 

Try to get a lawyer directly bro instead of bikeshop or solicitors, because the latter two is gona eat a bit commission.

 

Lawyer fees are fixed/controlled/standard.

last tym i got bang car,

but in the end i was the one who won,

eventhough the bugger tried to claim me 3k.

 

He didnt get a thing from me,

n my ncd is not affected.

 

And i got a lot of new parts for my bike, including full set faring+tank+sticker+disc break, ect.

 

But no get cash cos the shop eat it.

You said you are on the van driver's right and he made a right turn and hit you.

 

How on earth can you be on his right when the driver make that right turn.

 

YOU SHOULD BE ON HIS LEFT!

 

AND THE WORST PART IS, YOU ARE SHARING THE LANE WITH THE VAN DRIVER!

 

You make two mistakes here. Both of which is your fault.

 

How do you expect to make a claim on then other party?

 

I will now tell all these so call riders in this forum what I observe about 9 outta 10 riders on the road.

 

You keep riding at or on the blind spot of vehicles. Eithier when you are moving or is stationary or about to move. You are simply asking for it.

 

What you should do always and I will not repeat this, even for the new birds here is :

 

1) If you overtake a vehicle, make a quick and clean pass. Don't hang around that blind spot.

 

2) if you are stopping at junctions, when vehicles are eithier on the move or are going to move. You must either have made that clean pass, be ahead of the driver's vehicle or at least have cleared 3/4 of the vehicle. Never hang around slowly between two moving vehicles.

 

3) Always ensure that if you are going straight , you are on the lane that is marked for vehicles going straight. But if you are on the lane which allow both turning and straight movements, always be on the outside or flank of the vehicle which turns.

 

4) if you are turning together with another vehicle. Turn from the side, other than the side which BOTH of you are turning. Always allow a distance between yourself and the turning vehicle, becos car drivers are always bxxtards and eat into your space when they turn.

 

Lastly to TS, your riding skill and techniques cannot make it. You eithier have not learn much or adopted smart riding skills after riding for so long.

This. But seeing my bike small, driver went to "share" a lane with me. Not the first time this has happened though. Many times even if its left turning lane or even straight lane, drivers want to share lane.

I am doing fine man. Thanks for asking. My bike shop and their lawyers are confident of winning the case and they even provided me black and white that in the event anything happens, i do not need to pay anything. Its because i was telling them that i was not confident as i had only 3 days LD, no police report and no witnesses and i wanted to back out but was reassured that even 50-50 i also will get something. The lawyer quoted 70-90 in my favour but i am not keeping my hopes high.

 

Do you know roughly how long will the process take for a minor accident like this?

last tym, my 3rd party claim without police report is juz a matter of weeks.

 

No police report meaning to say never claim for injury,

juz claim for repair of vehicle.

 

If got police report i think wud be over a year.

 

If u got 3 days mc aredi can do police report and claim more.

The more mc the more can claim.

I didn't stop beside the van. He stopped beside me. Man, i am tired of saying the same thing over and over again.

 

Even so, how to lie and said he bang me from behind? The surveyor examine the bike can already tell roughly how the nature of the accident was like. Oh well.

ok, just a simple advise, next time just stop in the middle when you reach the traffic light first.

 

My claim took 2years be4 i get the payout. But because i need to go back hospital for phisco and checkup.

 

Dun think yours will take so long.
