I would like to share some thoughts regarding accident claims and insurance claims. Lets say if i were to met with an accident and aftermath of the accident, i'm able to claim 60 percent due to some reason or another . So its 60/40 for the case. How much do they compensate me ? For example if i were to get $3000 for the injury claim, with 60 percent, Is it 60 percent of the $3000 or ?? I believe some of you guys knew the answer or betta still knew how actually this thing goes. feel free to share some thoughts regarding this matter. :) thank you

i did asked my lawyer on this n she gave me a very clear pic.

 

ur medical bills + repair cost can claim only 60%. those r fixed cost.

however there's another claim which is ur sufferings for ur injury. the amt is known only after ur lawyer fights the case. then that cost will be slashed at 60% again.

then the total amt will minus lawyer's fee, est 5-10% (dependend on lawyers), the rest will be urs.

if u dont have any injury claims, then too bad, 60% of repairs only, however lawyers may fight some claims back like u suffered some trauma, etc. so conclusion is how good the lawyer fights the case.

Accident can happen anytime, anywhere.

However ask yourself, do you want to fall at 120km/h or 60km/h?

To add to @arthur_chan's detailed legal advice, there are some lawyers who specialise in motor accident claims (and some even specifically for motorcycle accidents). They are usually riders themselves, or have been.

 

A lawyer who understands the competencies required to ride a motorcycle, and the dangers faced, will have a better chance of winning the case for you. When in doubt, always start a telephone conversation first. Don't just happily go to their office and get charged attendance fees. Better yet, get a secretary (I'm one) to brief the lawyer thus saving you the long appointment (which can be like $2-300/hr attendance fees).

 

In case you're asking, yes, I know some accident specialists.

okey cause i've been in an accident recently and i tow it to a shop to do the necessary claims and stuff. They said the lawyer will call me to elaborate futher about the procedures and also the claiming process. And also to interview mw regarding the accident. But a week pass and i didnt hear anything from them. Called up the shop and they say the lawyer will call me up soon. I began to feel uneasy about it. Feel as if my case was taken lightly. I suffer abbrasions and also swollen rib and hips. Well what im stressing nw is i dunnoe what else to do and kinda lost...anyone keen to help?

what i can advise if u trust the shop n lawyer, take it easy n heal up ur wounds 1st. if u've made those necessary reports: idac, insurance and police, let them handle it, these kind of insurance claims wont be settled for at least a few months, and could take up to years. in due time, TP/lawyer will call u up for a face to face interview, and that's when u cannot foul up(on TP side that is). use that time to think how to describe the situation as clearly as possible n review if u've missed out any points. the more time they give u is actually to ur advantage.

 

also when it's time to repair ur bike, talk to ur shop n review all those cost. always ask them what if u cannot claim, how much cost they bear, and how much u pay. have them put down in black n white.

 

in my case, the other party took at least 5mth to get their claim, and on my side i'm still chasing. according to the shop, the other party keep ignoring them.
