Insurance claim

Last four months, i had an accident with another bike. The bike hit me when i was turning as a result, it hits my rear tire and i skidded and fall. Due to the damage n injury, decided to make an insurancd Tp was there at the incident. Took statement n etc. The other party is not badly injured except for minor abbrasions on finger, and some minor damage on the bike. The one who suffer is me. Abbrasions. Hips and upper body swell. So after doing all the accident report and everything, i leave it to the lawyer to settle it. Most prolly its at 50/50 case or 60/40 because i do not have a witness. Tp sent letter and say its still pending.Well today, i decided to call ntuc and ask how much is the reserve amount of claim from my last accident. The ntuc staff said the other party claim nearly 8k plus for the accident. But still pending Was shocked. How can a person who is not badly injured, bike not badly damaged And the who hit me claim so much?

 

Anyone can help me on this? I wont let him get the money easily. My injuries is more than his and my bike damaged is more than his and he is the one who hits me, and nw

wanna claim that amount? Its way too much. What can i do now to resolve this? Should i call my lawyer or insurance cmpany?

 

And and cn anyone tell me what is reserve amount ??

claim 8k depends on what he is claiming.

 

usually, claim can be divided into 2 parts

 

1) repair bill

2) misc claims (medical, loss of transport/income (eg. taxi) )

 

however, why is it 8k then i don't know already. most probably the reserve amount of 8K is the max your insurance company is willing to pay.

in a no witness case, it is very difficult to get a 100/0 case.

 

so no choice, will depend on what his statement is.

traffic lights got camera, go check with LTA if they can pull out the footage.

not all traffic light junction has camera, only those major road junctions. and that is called a "junction eye"

His lawyer is claiming 8K from your insurance company? What bike was he riding at that point of time?

 

And besides, I don't think NTUC will bear the full 8K claim. Usually they'll bargain it down to an amount both parties are willing to accept, which is much much lesser than 8K I can assure you that. I would advise you to contest this and inform your lawyer/bike shop/whoever is handling this insurance claim for you about this and see what are the options available to you.

 

But be forewarned, this will turn out to be a very long and painful process and you might even be required to produced all your medical certificates and receipts(so keep all of them) and you might even have to make appearances in courts to fight your case. I'm guessing it'll be a year or two at least before this case concludes.

bro, u mentioned that there's another rider behind the two of u. isn't that ur witness already? anyway, it is very diffiult to see who is at fault since ur details are not clear on how the accident actually took place. if the other bike is of a continental model, then an 8k claim may not be exhorbitant also. so,it really depneds.
