Is it possible to claim against the other party if we have the other party's vehicle plate number? Recently, i suffered a hit-and-run situation whereby i managed to vividly capture the car plate number and also the description of the driver.. Need some advice here! Thanks!:dozed::dozed:

Done with lodging report on the accident after i was discharged from hospital... And also with GIA.. Just wanna know anyone had the same experience as mine?

Yeah.. The police went down to the car owner house but didn't manage to locate the driver nor the car. Still pending i guess.. Haven't receive a call from them... May i know any riders have the same exp as mine?

heres my understanding.

 

if you hospitalized more than 3 days, then it is a confirmed criminal case and the other party is charged with hit and run. the police must pursue in terms of criminal element, not in terms of your compensation, but thats even better for you coz when confirmed crime they have to LL pursue all leads. and if you have plate number and its a local, heck how to escape right?

 

but that doesn mean you confirm get compensation. it just means the police will do their best to catch the fella, and frankly with number plate no escape for him. after he gets caught, and proven he was the fella in your accident, no matter whose fault the accident he will be charged for hit and run with possible jail. after that then separately investigate whose fault and how much compensation you should receive. if you are 100% at fault (example only), means he go jail for hit and run but you oso dont get compensation.

Thanx for the help.. I only know about 3 days MC then confirm police case. That's all.. Didn't knew about the compensation process though.. Only was told that no matter what in an accident.. Both would be in the wrong... Just percentage diff only.. Just like GE! LOL...

care to share how do u get into hit and run accident? i.e. how the car get away..

 

its good to prevent similar situations among the riders here..smtimes drivers are just...pain the the $%^&

Was travelling along the first lane along SLE and cruising about 90km/hr to 95km/hr on my super 4 when this car driver from far was speeding. Saw from my side mirror that he was getting very close to me by the seconds and before i could give way, he kiss my backside already..

 

After that, he overtook me on the center lane and i saw he was damn happily talking on his phone.. honked at him to stop but never stop instead show me the #$%^ look and pretend innocent.. Finally he did stopped. Thought he now then want to settle things but he never came out of the car.. Instead engaged reverse gear and went straight for me and my bike. LL, since we bikers no reverse gear cannot run away liao.. so just have to hold onto the brakes and since the impact eventhough he accelerate quite fast, didn't manage to hold onto the bike and immediately have to let go and drop... KNN, then straight away speed off.. Lucky manage to get the KNN car number.. But now my case still hanging in the air and TP have yet to get back as to how the case is going now. Now, bike ready for collection but the cost is $2800 and i have to pay first... Cos like what mechwira say... Cos like what mechwira say... He may be put behind bars but now the insurance company may not pay as they see this as not neligiece but deliberate action to cause hurt which is not covered under their clauses.

is this what the insurance company said to you, or just something you deduced?

 

coz a few years ago i got into a small argument with another forumer about insurance payout if you're the victim of someone else drunk driving. i insisted that there were newspaper reports of these victims saying they were refused compensation from the drink driver's insurance because driving driving was not covered. so the victims had to resort to getting lawyer themselves and directly suing the drunk driver, which was worth it only if big damage and/or injury. the other forumer on the other hand insisted that the drink driver's insurance must pay out to the victim even if drink driving and later on claim directly from its drunk client, because this is 'the law in place to protect victims'.

 

our little argument was never resolved.

 

so now are you implying the insurance company has expressed refusal to payout to you on account of the deliberate act?

 

if yes, thats 2 things that makes us LL no compensation: drink driving and deliberate attempt to injure/murder.

btw ah.... in ur first post when you said 'vividly capture his plate number'..... did you mean an actual photo or just your memory?

 

coz if memory.... suck thumb man its your word against his. they might find evidence of his involvement, then again they might not.

 

photo is different story. he might still dispute your version of events, but simply by proving he was indeed the person in the collision then he is indeed guilty of hit an run even if he disputes your story. its just a matter of whether will be charged with deliberately causing hurt on top of hit and run.

 

but if just memory... then i understand why the long wait. must prove he was indeed in a collision with you.

more or less the same thing. insurance will not cover any intended or self inflicted claims.

say for 1st party, u deliberately smash ur car into the wall n claim urself, if they have evidence u deliberately did that just to claim, they can refuse ur claim.

similar to drugs, sucide case, which is classfied as self inflicted. no insurance will cover it.

Accident can happen anytime, anywhere.

However ask yourself, do you want to fall at 120km/h or 60km/h?

Yap2... That's what my lawyer said... Insurance will never pay out any act of deliberation.. Meaning that if it's not cause by negligience itself or accidental... I'm injured and was conveyed but that will only help to bring the driver to justice but not bring justice for damages on your bike. :sian: have to fork out $2800 for repairs...

Drink driving, deliberate act and also if the driver has no license or insurance coverage... These are the things in which no insurance company will pay compensation... So LL you have to engage a good lawyer to claim personally with the driver. If the driver no money to pay you even if you win, then good luck also.. So both way for my case, i'm still at a losing end. KNN!

unless the other party declare bankrupt, then u have to pay some % lawyer fee n bear ur own cost.

imo, $2800 + ur injury claim can approach a lawyer to sue him.

Accident can happen anytime, anywhere.

However ask yourself, do you want to fall at 120km/h or 60km/h?

Hahaha... Only can pray hard that he get into the same situation and only then he gets to feel how deep his pocket will burn... But i think he can afford it since the F***** drove a lexus... Pffft!

Latest update which i got is that for accident cases there are 2 types.. Accidental & Criminal... If accidental confirm you will get your pay out... If Criminal means all the damages done you've to fork out your own money like my case and kiss the money good buy cause the insurance ain't gonna pay any single cent.

Many years back, my sister who was driving my parents car, was banged from the back by a drunk driver. My other 2 younger sisters were in the car while my sister went out for a few seconds. The behind smashed, bumper drop off etc.

 

To cut the long story short, the guy was fined dunno how many thousands and licence suspended for i think 1 or 2 years. The repairs my parents forked out by themselves how many donkey thousands, insurance is not gonna pay. Damn not worth it man.

Yeah man... Sometimes not fair.. But what to do... Not covered by insurance... Renew insurance must pay by deadline.. But when claiming... Alot of things cannot here and cannot there.. end up get nothing..
