Any comment on the best approach for the rider from technical side for this accident

Saw this video from ROADS.sg,  a reckless driver came out of a carpark lot without due care on coming traffic and was hit by a taxi which had the right of way,  but the reachout was the reckless driver won the insurance case without suffering any lost at all.

The reckless driver won the insurance case without suffering any loss at all regardless the Barometer of Liability Agreement

Two things came into my mind,  1.  A good lawyer is essential;   2.  What's the best approach from technical side if it's bike.

Saying riding around 35KM/h and have the right of way,  noticed a car tried to roll out from road side carpark lot suddenly, warn the driver with a honk and flash high beam as well, but the asshole contiued to proceed,  assuming the E-stop will fail

Based on the case of the video, these two scenarios would lose the insurance case

   A.  lowside crash without hitting anyone or assets, only cause damage and hurt for rider self.

   B.  highside crash and hit the car or other assets,  cause damage and hurt for rider and third party

Because the argument is speeding. In my opinion, riding in 35KM/h is quite normal in this sort of road, but the speed limit usually would be 20-30KM/h,  it's definit speeding.

Wondering if the best approach is to try to pass by speeding up without any hesitation, though it looked like more dangerous.

1 - if you going to bang the car backside or side.. brake no matter what.. put legs down in case you lose balance..

2 - if you can reached the car's front bumper.. and it bang your side with it's front.. you will usually win the case and just proceed.. (to minimise your own losses) but there's a possibilities.. that your leg might be crashed.. 

thus motorcycles are usually on the losing end..

Yes, your're right.  Just thinking that aggressive riding might be better than defensive riding for certain scenarios.  Only bravery wins ?

not really.. bravery might cost a leg for the rider.. even if you win a lot of cash,, you might lose a leg forever.. doesn't sounds worthy?

Bike riders always lose in a crash. So don't even try to "win" the space. 

If you value your life and limps... just let people go if you are not in any danger from the cars or TRUCKS behind you. The only time i'll slot past as high speed is only when there is a crazy truck chasing after me from behind... Lesser evil...
