hit pedestrian anyhow crossing at traffic light. whose fault?

ever encounter when you squeezing in between cars when the traffic light is red then suddenly got people decide to cross the road, not at the pedestrian crossing but in between cars? if sway2 u hit these people whose fault will it be?

 

this morning it happen to my friend and the pedestrian is willing to pay for half of his medical and damages fees. his mirror is broken when he fell down trying to avoid that person and he say he got back pain. the pedestrian only got minor bruises on his arm. can my friend get the pedestrian to pay in full instead of just half?

erm... in the eye of the law, i believe ur biker frend is in the wrong

no matter wad as long we hit pedestrians... we will not get off scot free

the pedestrian might get his due punishment as well but cfm we will get something on top of the damages to the bike & injuries to ourselves

Bro Reese is right. No matter what, the law always have some reservation for the pedestrains. I have encountered riders who hit pedestrains who just dashed out of the roads. The riders' insurers have no choice but to compensate part of the injury even though it is not our riders' fault.

 

It is time TP change the law. It sucks.

This would usually fall under failing to keep a proper lookout. It's the duty of the motorist to keep a proper lookout for others including pedestrians.

 

If you say that you can't see properly when riding between cars, then I would say that the response would be that if you can't see, you either shouldn't do it, or adjust your speed accordingly to those conditions.

i don't really agreed on "failing to keep a proper lookout" when that happen.

some pedestrians are really dumb. like suddenly cross the road when the traffic light is green. then what the use of pedestrian crossing?

 

eg, if a fellow crossing MRT track and got bang by the train. who at fault? the MRT driver or the fellow who cross the track?

 

 

i do agreed with leong77, time for TP to review the traffic rules

 

but that kind of accident happen, driver/rider just suck thumb lor :sian:

I encountered a similar incident just yesterday.

I was driving and this stupid man cross the road right in front of a SBS bus without checking for traffic which caused me to nearly hit him with just few inches to spare.:sweat:

I was lucky not to hit him or else although it was not my fault but if something happens I am definitely partly responsible for this stupid act by an ignorant pedestrian. :giddy:

so like that, every times ride pass a bus just press your horn lor..

anyway, even you press your horn, some of them are just too stupid to understand.

 

i met some ppl walking in the center of the road in carpark. i don't want to horn them as my horn super loud, so i just rev my throttle, but they dont seem to heard it and still happily talking. till finally i cant stand its and tap my horn and finally they notice me. :faint:

 

last month i also almost bang a pedestrian at AMK central at the car park entrance beside the Big Mac center. traffic light Red man appear, the old man still want to rush across the traffic starting from pavement. luckily for us, either he run too slow or my respond fast enough, managed to stop in time.

 

just F up the old man in hokkien. just because of 1 old man in rush of few mins and cause endanger to 2 person lives ( rider and pillion ).

Some Pedestrian r really inconsiderate when crossing at traffice light. i believe everyone encounter before when its red ppl who cross halfway still like taking a stroll in the garden. whereas all the vehicles trying to turn r waiting for those to cross. Some r even worst when the green man turn red they still wanna make a dash over. i always see those who cross zebra crossing n traffic lights without checking the traffic n just cross regardless of whether theres ani traffic. didnt primary school teach kids to check left check right check left again den cross? time to educate pedestrain!

When you approach pedestrian crossings or traffic junctions... you slow down and get ready to take evasive action should anyone decided to cross without warning.

 

When squeezing or riding between STOPPED cars caught in a jam...slow down and be prepared for people to suddenly appear in between the vehicles. As long as your view is blocked by the next vehicle... assume that there will be someone crossing your path without warning.

 

Whilst riding... take note of the areas and situations where the potential for an accident is high and adopt a defensive posture when in these areas or situation.

 

Defensive posture?? Slow down, brakes covered and constant visual scanning of the road and conditions coming up.

 

Our public roads are more dangerous than the race tracks. That is a fact.

 

Ride safe everyone.

Next time, do like what I do when I meet this kind of impatient people.

 

I will make sure I have some entertainment and make sure their frustrations and impatience boil over... hopefully to make them so mad that they get a stroke or die of heart attack or get so mad that they will drive recklessly thereafter and end up in an accident or get a speeding citation. :thumb:

 

1. Turn on your hazard lights.

2. Get out of your vehicle.

3. Wave your hand at the other drivers in apology.

4. Open the hood or boot and pretend to inspect the engine.

5. Close back the hood or boot and wave again in apology.

6. Get in the vehicle, turn off the hazard lights and drive on.

7. Always smile when you are waving your apology to the other drivers.. its only courteous to do so.

Just be extra cautious when you stop to let people cross at those Zebra Crossings . Not every motorist is (traffic) law abiding and patient to let pedestrians take their time to walk across .

 

If you indeed want to stop , try to give a lot of space on your sides just in case the vehicle behind does not anticipate you stopping .

 

Just giving my 2 cents worth as i had a near miss more than just once .

Move off really slowly. As slow as possible and keep looking down at your engine as though something is wrong and when they try and overtake you.. you just accelerate fast and go in front of them...bottom line is to rub it in that no matter how he horn... he will still end up behind.

you really need to know what youre doing for this one. cos some drivers can be a real ass.. like a suzuki swift i came across some weeks back, who thot he was as slim as a bike and wanted to squeeze between me (in middle of lane) and the car on lane one.o_O

 

Maybe he's a rider too..Sometime we forget what we are driving...I once drove my friend's prime mover just to get the feeling of it(dunt worry not illegal coz i have the lic)..After reaching the destination,he just tell me "Aye,u ride your bike too long already till you drive my prime mover like motorbike,everytime u like to squeeze.." Wahhh i feel so paiseh...

 

 

Anyway for threadstarter,what i think its already good enough that the other party is willing to fork out money.I had a case 4yrs back where i was cycling,hit a pedestrian on the road due to jaywalking.Got fine 200SGD-6pts and now the other party wants to claim med. fee of 14K... :cry:

but imagine if u nv check n get hit. the one who suffer is u also mahz. just like bike get hit by car pedestrian is also the same.
