Can somebody help me on what i should do.

I had an accident yesterday while travelling on the CTE. Another car changed lane abrubtly and thus I smashed into his rear bumber. I had my biked towed to my own workshop and the other party had towed his maxda 3 to his own workshop.

Now he claims that his vehicle's rear bumber and side panel is damaged and wants me to pay $1500 for the damages. I told him that him he wants to settle it privately then tow his vehicle to a workshop of my choice would be cheaper but he is not willing. What should I do. If I settle it with the insurance company then would it be my fault and most probably who would be claiming against who?

Fellow Bros

Really need advises from many of u. First let me explain the incident.

Last Sat 1230 I was collided with a Corolla Altis at the junction along Jln Basar X Lavender St. While I moved off at the traffic (GREEN) light towards Balestier directions. An SGA plate Altis beat the red light while making a right turn and bang directly to my right side and flung me off my FY Shadow Ace. I was then got up with my feet and luckily only a deep cut on my right heel and bruises all over my body.

My Bike was not seriously damage, thanks to my Crash bar and boxes and wing rack to took on most of the impact and I escape alive.

Later I was sent to TTSH received 7 stitches and discharged at the same day with 14days MC. Before I went home my wife drove me to TPHQ report to IO and the IO told me they will put on charge on the driver as a traffic camera at the junction caught him in action.

Just addition on that incident, before he hit hard on me, he have no intention to brake his car until he cause i and my bike somersault then he brake. I was damn angry at first and questioned him why he never brake. He only look at me speechless.

And now I am resting at home, my bike now in the bike shop waiting to file a claim against the driver.

Wanna to seek advises from senior bikers on the procedures and what to look for during the process of claim against other party… do I need to engage a lawyer to represent me for the claim?

Pls enlighten me thx a million

Hi guys, can i seek your help as i was involved in an accident ytrday. At a T-junc, i as going straight and a trailer turn right from the minor road to the major road i was on, I got a slight hit at the rear end of the bike but enough to send me crashing to e kerb. I called e police and ambulance. I rmbed his car plate, but in my frantic, aft i got discharge from hospital i cant recall the no! At e scene e uncle admitted all was his fault, he keep assuring me, but aft tt i was sent to hospital. the TP took down his details though. I am kancheong now cos I scared the uncle will deny later since I don?t know whether the TP took down his statement immediately. And I got a witness ( the car behind who came to help me). At the hospital a police came to ask me to arrange a date to go down to Ubi HQ. but the form says i have to bring licence insurance and police report. 1) does tt mean i have to go and make a report again? cos i tot the traffic police at e scene saw everything. Aft reading this thread, i called my insurance company, but they said they will not be involved if i want to claim e trailer uncle insurance, said i have to get a lawyer and make e claim. I had stitches on my leg and 1week mc, other than tt no major injuries thank god. 2) so do i have to go and find a lawyer now? or should i wait until i go down to the Ubi to give my statement. and lastly the TP at e scene said he will take care of my bike... and i have no idea whats happening to it now, but i wished to have it repair asap cos i am a NSF staying in east with camp at west, and transport is rather inconvenient. Sorry for having such a long essay, but am really abit lost now. Thanks for any advices fro me kind souls!

hey.. ur case is similar to mine

mine is im going straight but the taxi is turning right into my lane

im on green

he is suppose on green

but he is suppose to hv waited to me before he do any move.

anyway, after i met the accident, i have been conveyed to the hospital. when im been conveyed, the police has not come yet. the taxi driver stayed at the place to wait for police to come.

the taxi driver commented to a passerby that both of us were green light, both of us wanna pass. but i think that is not what he told the IO who is Staff SGT willie back then.

I am still waiting for the outcome of the result , as i got a letter of proseuction from the TP, my bike shop advised me not to do any claim.

The taxi driver got his copy as well as what im been told by IO.

My bike shop quote 1180 to repair my bike plus towing.. they ask me to repair on my own , which they claim is better.

i feel so ridiculous, because im not at fault but i got to pay for innocent $$..

but anyway, i have contacted a lawyer referred by one of the fellow biker here.

the lawyer ask me to proceed on repairing my bike, but before that take pictures of the damage. he will follow up..

haiz..

I was involved in an accident at Jalan Kayu on 19 Oct 0750H... A lady driver who exit from the Esso station hit me while I was travelling on the main road.

I was shocked and was taken to a nearby clinic by the driver. I reported it to the police and even tried getting witnesses ... which was unsuccessful... sighz.. My bike shop had asked me to engage a lawyer which I did..

The questions are... Is it a must to engage a lawyer for making Claim against the driver? What happens if I lose the case? I am afraid its my story against her now .. sighz.... If I lose.. I dun think I can afford to pay the lawyer ....

Still recovering from 8 day MC given for my back injury... sad man ....

I was recently involve in an accident.....

Then if the other party's insurance ppl call me to ask

1. am i claiming for injury?

2. Claiming medical bills?

and so on and so forth

Does that means that claim is successful?

As in the other party is at fault and the Insurance is goin to settle it?

Because the car didnt admit his wrongdoing and just gave me his number and drove off....

Thanks for any reply

Mine is limited knowledge but here's wat i know thus far...

If there is injury, then you must report TP... fill up all the necessary forms and send your vehicle to idac for inspection is necessary....

For injuries, you will have to proceed with seeking your own treatment and proceed to sought claim. If the amount of medical claim is large and your injuries require a substantial period to heal and TP investigation is in your favour, then employing a lawyer is a better option.

Back injury is no joke and can have long term impacts... so better make sure you receive proper treatment.

Consult a lawyer. It is their job to advise you whether you have a case and whether it is worth it to sue.

Just be careful that you preserve all evidence like claim receipts, invoices, witnesses' contacts etc, and must claim within 3 years.

Even if you do not have a 100% case, it may be worth it to claim if the damages that you can recover will help compensate your loss and expenses.

Cheers

first thing... we are glad that you survived http://www.websmileys.com/sm/cool/cool36.gif

now your queries:

Is it a must to engage a lawyer for making Claim against the driver?

claim is against the driver's insurance policy, not the driver (unlikely that she doesn't have one)

highly advisable coz you have to file lots of claim/legal documents and the driver's insurance company will be represented by a lawyer

What happens if I lose the case? I am afraid its my story against her now

there's always uncertainty, but it seems you have a case coz you were traveling on the main road and she was just coming out from the petrol station. traffic rules says she has to give way. but for sure she will come up with some nonsense like you were speeding and suddenly appear, you were stopped but suddenly move off when she turn out... all kinds of crap.

very important thing is your police report and the accident site diagram you

draw, indicating the positions of your bike and her car. surveys to damages on both bike and car could also tell many things... impact angle and likely positioning, damage extent and traveling speed, etc.

even if you win the case, you will still have to pay part of your lawyer's fees, your lawyer will deduct from the compensations you get from the drivers insurance. remember to discuss, agree on amount and get proper bill

Still recovering from 8 day MC given for my back injury...

remember to seek proper treatment for your back injury, go see specialist. i had my accident in 2000 and my back is still no good after 7 years. sit longer, stand longer, walk further, sleep angle no good all cause backache... darn jia lat.

advise, do not let your lawyers delay your medical examinations, push them to arrange for you the MRI. my lawyers failed to arranged for my MRI scanning (more detailed pictures than x-rays) to determine the extent of my injuries until about a year later. by then many parts already slowly healed. unlike fractures and cuts (can see), back injuries are more complicated coz injured parts are usually ligaments and tendons (tissues). late scan showed little so my compensation also very little. don't let your lawyer drag your case till final year for claim, they always do the "bigger" cases first (earn more $$$ mah). think they charge only around $2K or less for smallish motorbike cases like yours. not sure the going rate now o_O

as for what you can claim, see the details in my other post...

http://www.singaporebikes.com/forums/showthread.php?p=3466963#post3466963

good luck http://www.websmileys.com/sm/cool/487.gif

may all be well and happy

Posted

Not sure if you can negotiate, but some pple have told me that the other party would be liable for your legal cost if yours is a sure win case.

Personally, I am comfortable with a percentage cut only if the percentage is taken out from the compensation amount over and above what i've paid for medical.

Don't take latest car accident reporting rules lightly

Lorna tan

Sun, Jun 01, 2008

The Straits Times

If you are one of the 800,000 motorists in Singapore, take note of a new initiative that sets out new procedure you must observe from today.

Launched by the General Insurance Association (GIA), it requires you to report all motor accidents to your insurer within 24 hours or on the next working day.

It does not matter how minor the accident is, and the requirement applies even if there is no obvious damage to the vehicle.

The new procedure is not to be taken lightly because not complying with it will result in penalties. They include the loss of your no claim discount (NCD) and the risk of having your claim prejudiced or declined later by insurers.

Not surprisingly, motorists have had a lot to say about the initiative.

Some say it will be troublesome to have to report all accidents to their respective insurers within the stipulated period. In the past and in the absence of penalties, many motorists did not report accidents when they could make a private settlement and/or there was no damage or injury.

Recently, a motorist wrote to The Straits Times Forum page asking if insurers could find other ways of reducing their motor business costs rather than 'penalising' motorists with the new measure.

Others wonder if motor insurance premiums could be lowered in future if indeed the new measure does manage to arrest exaggerated motor claims.

Rising motor claims

After all, motorists have been coughing out more over the years because of rising motor insurance premiums, which have surged by around 20 per cent from a year ago. This rise was driven by the mounting motor losses the industry had been experiencing.

At a recent press briefing, GIA president Derek Teo highlighted the dire straits that motor insurers were in.

'For every dollar in premiums that we collected in the last two years, we paid out $1.20 in claims and other expenses. The current rising loss situation is not sustainable.'

Last year, motor underwriting losses hit a five-year high of $103.2 million.

Mr Teo attributed the poor results in the past two years to a price war arising from renewed competition since 2004, when the motor insurance sector returned to the black after an earlier slump.

It had suffered 12 years of losses, which peaked at a record $120 million in 2002 amid inflated repair claims and runaway third-party costs.

Given this backdrop, it is not surprising that the new initiative is backed by all insurers in Singapore.

Here are some frequently asked questions about the new motor claims framework, and what the insurers say:

Q: Why is the new framework necessary?

It is a best practice undertaken by all motor insurers in Singapore, and provides clear and standard procedures regarding what to do in the event of a motor accident.

When involved parties are forced to report their accidents 'fresh', the incidence of people lying and collaborating with repair workshops to inflate claims is drastically reduced.

This will provide motorists with a better claims experience and help contain insurers' cost of claims.

Q: Will the new framework translate into higher premiums?

On the contrary, it will help to contain the cost of claims for insurers. And if claims are managed well, premiums should not rise.

Q: Do I have to pay any reporting fee to the insurer?

No.

Q: What if there is no damage to my vehicle? Do I have to inform my insurers?

Yes, you have to report all accidents to your insurer no matter how minor the accident is.

This is the requirement even if there is no visible damage, or even if you have come to a private settlement with the other driver.

This is because you can never be absolutely sure that the other party will not file a claim against you later.

Q: Do I still need to report to my insurer if I do not intend to claim from any insurer or third party?

Yes.

Q: What happens if I choose not to report the accident to my insurer?

Failure to make a report within 24 hours or on the next working day will affect your NCD when you renew your motor insurance.

For private car owners, this means losing 10 percentage points of their NCD if they do not comply. For motorcyclists and owners of commercial vehicles, the penalty is 5 percentage points of their NCD.

Not reporting will also put you at risk of having your claim declined later by insurers.

Q: Will the new framework apply to all motorists?

Yes, the framework applies to all motorists.

It will be a policy condition that all motor insurers will enforce with effect from today.

Q: What if I want to send my car back to my car dealer or favourite mechanic?

Each insurer offers different types of motor insurance plans, some of which allow customers to use any workshop.

You have to check with your insurer on this point.

Q: Can I still use Idac (independent damage assessment centres)?

The new framework does not spell the end of Idac. There is no change to the process at Idac, which is used by some insurers.

Resolving disputes

Meanwhile, drivers in disputes with insurers over motor accident claims now have a venue through which to settle them under a new mediation scheme.

If your motor accident damage claim is below $1,000 and involves no bodily injury, you can file your complaint with the Financial Industry Disputes Resolution Centre (Fidrec) under the Fidrec-Nima (non-injury motor accident) scheme.

The scheme was launched last month, and is expected to help settle cases more affordably and quickly than going before the courts.

The scheme applies to disputes where consumers claim against an insurer that is not their own insurer.

Where disputes are resolved through mediation, Fidrec's services are free of charge for the consumer.
