i juz had an accident tis morning

 

the suitation is like tt I was on mine way to mine camp

 

as per normal morning ard 0710 and heavy traffic and i saw two car was

 

quite close to one another so i slow down and suddenly a motor cycle hit me

 

from the back and lost control and hit the right side car, while he hit both

 

the car...In this suitation who is at fault? cos he hit me den i lost control hit

 

on the right hand side vehicle

Today, just after I turned out from a small road (right turn) , Hume Ave into a main road, Upper Bukit Timah Road, at about 20m, I was hitted by a car on my rear right side panniers. When I was hitted, I was already going straight. My right side pannier cracked, while his front side panel (just in front of the left front door was scratched and dented in. He claimed that I never keep a proper lookout. How whose fault? My friend advised me mostly likely is his fault since he hit my rear. (Only my right rear pannier were damaged) I was thinking to claim his insurance. Help:help: :help: :help: :help:

That depends what you mean by victim. If you are referring to a victim as a third party (such as a passenger or pedestrian or someone in another vehicle) who was injured by the rider's actions while he was riding, the answer is yes.

 

For bodily injury claims only, the insurer of the vehicle has to pay the injured third party regardless of whether the driver stole the vehicle, is drunk, has no licence etc.

 

This is the protection under the Act for third parties injured in road accidents. Don't let people who know less mislead you into thinking that you cannot. Speak to a lawyer.

Now it seems that you are more concerned about property damage. If it is a property damage claim, you should consult a lawyer and check if it is worthwhile to sue the driver personally.

Injury had been processed. im concern about the property due to extensive damage amount to 5 figure thus paying for it due to irresponsible motorist is not reasonable. i think i should do something about it. Thank you for your kind advice.

For those who insure with NTUC INCOME:

 

Theft Outside Singapore

 

All motorcycle theft outside Singapore will be subject to a further excess of an amount equal to 50% of the market value of the vehicle at the time of loss subject to a maximum of $2,500. The effective dates of implementation for New Business and Renewal Business will follow:

 

New Business : from 1 January 2009

Renewal Business : from 1 March 2009

 

 

So what do that mean?

 

If your bike market value is $1,500, you can claim $750.

If your bike market value is $4,000, you can claim $2,000.

If your bike market value is $7,000, you can claim $5,500.

If your bike market value is $12,000, you can claim $9,500.

If your bike market value is $25,000, you can claim $22,500.

And so on…

Anybody could assist me in giving your opinion in my case.. I had an accident in Joo Chiat Rd last Saturday.It was a two-way, one lane road.Up ahead was a red traffic light.And the traffic was heavy.So i was riding on the left side of the road(overtaking),to get in front of the traffic. Suddenly,as i was passing this car,the rear passenger door suddenly opened. I did not even realize that until i crashed on the pavement. I sustained minor injuries,my bike was quite damaged on the outlook.The driver called the police,and i was conveyed by the ambulance. So my questions are:

 

1)How do i go about reporting to the insurance?i've made a police report.

 

2)Is it my fault?the reason i went ahead, is because the car didn't switched his hazard light, near a traffic light, and on the double yellow line. If it is my fault, how will it affect my claims?will i able to claim from his insurance?

 

3)In such cases, will i need to pay to the repairs to the bike shop first, or the bike shop will settle the case for me.

 

I really hope you can assist me in this matter, as this is my first accident in 3 years. Thank you.

you can claim against the other party's insurance, so can the other party claim against your insurance. if you are not at fault, your insurer will not pay for the damages claim by the other party. if you are at fault, your insurance will be affected.

It will depend on the bikeshop you go to. show the bikeshop the report you have made.

Beware. Yours is not a straightforward case and any claim you make could be quite challenging. If you really intend to claim for your minor injury and damage, you would do well to get some advice from a lawyer familiar with such cases.

 

Another "car door opening" case was heard in the District Court in 2007 [Lee Mei Alice v Ivano Perazzeli]. The injured pillion passenger didn't succeed in claiming against the driver of the other vehicle because the driver was not negligent on the facts of that case. The claimant could potentially have made a claim against the passenger opening the door (and hence the passenger liability part of the motor insurance policy would have to defend) - but no one knows how that would have turn out.

When you made a claim against 3rd party, it means that you are claiming against the other party's insurance. Since you are claiming against the other party, your insurance will not be affected... provided the other party does not counter claim against your insurance.

 

when you renew your insurance, your case on that accident may not be closed. the insurer could be setting aside an amount for the other party to counter claim against your insurance. Since it is time for you to renew your insurance, your insurance will be affected. If your case is closed, inform your insurer with proof that the case is already closed and your insurer will reinstead your insurance.

hi bro. i've recently met with an accident involving a taxi who cut across the chevron line and hitting into me.

 

assuming for this case it is ruled in favor of me, what are the various things i can claim? i suffered from multiple abbrasions. I am also not sure if i have any knee problems and i am going to check it out.

 

Will i be able to claim money (not just payment of medical) for my injuries? if so, what is the claim called? claim on pain? claim on inconvenience?

 

any other things i can claim against? loss of transport?

 

if further down the road when i go and check my knee and i find out there is something wrong, can i still claim against him? or is there a time limit to do so? (the accident happened on fri evening and SGH discharged me for multiple abbrasions)

in addition, when i got the MC and receipt from SGH, it did not state that i had multiple abbrasions. is there any advice on this?

Dear friends,

i need ur help. I was involved into a bike accident and the car rammed into me from my side on a T- junction.

I was brought away from the scene by ambulance to ttsh. upon xray, we found out tht i have fractured my 1st toe of right foot.

im on 6 weeks mc.

does any1 have an idea abt the claims? how much could i be able to claim?

hey guys i got a question.

 

I was on the way home when i reached a traffic light turning red, i had adequate time to brake so i did but i ended up hit in the rear by a car. My handlebar, seat, lights and mudguard bent or broken, engine not sure, sent to bikeshop. It was a minor collision, got some minor scraps on my elbow and ankle. However my right wrist hurts at a certain angle.

 

We decided we'll probably settle this in private, i got her details, she's got mine. Whats the next step? I need to settle within 24 hrs right?

Hi got a question.. I met with an accident 3years ago w a car.. Have not claim anything yet. called e lawyer many times but was told working on it.. Its 3 long years yet the lawyers said its normal.??? Is it true??? What should i do next???

No it is not normal. Write to the lawyer and ask specifically for an update of the status of your case.

Good evening guys. Today i met with a accident. I parked my bike at Kent ridge wing NUH basement car park. When i return to my bike after work, i found it a few meters away from my actual parked location. When i parked in the morning, it was in main stand. When i found it was in side stand. Left side of the bike heavily damaged. Mirrors broken. 2T spilled on to the floor. It seemed some one hit/pushed my bike on the left. After that carried it back up and put in side stand. Best part is that all of this happened in front of the cctv. I told the security about it and he told me to make a police report.

The police have made the type of accident hit and run.

 

 

I now have the statement with me. I have to fax my insurance to TP within 24hrs. So the qns i want to know now is:

 

1. Can i go and do the repairs on my own expenses or wait?

 

2. Insurance policy is from NTUC. Next time i renew insurance will it be high? As this is not my fault. This is my first claim in 3 years of riding.

You can repair your bike and keep all your receipts and wait for the police completed their investigation

You mean your insurance is from NTUC or the person who hit and ran away? If there is no claim from your insurance, your insurance premium will not be affected.
