I have this friend who claims to have a driving license but however always unable to produce it and insist that he has a license.

 

Lets say one day if he were to kenna a road block and the police found out that he has no license, would the passenger who boards his vehicle with a driving license kenna?

 

 

He would be a laughing stock at the end lol but would still like to find out whether if the passengers with a license get into trouble? as they truthfully did not know the bugger driver had 1.

For ur own safety,stay away from him,if happen an accident,and noeing he doesn't have a license,u think he wanna be responsible for u?

I remember hearing that if the driver is drunk and he is still driving but the passanger who have a licence and still let him drive, the passanger will kana also. But as for the licence or non licence thing well.. dunno... but you can definately argue that you didnt knw he doesnt have a licence but we cannot argue that he is not drunk mabbe. Hmmmm good question but i think have to let those working with the authority to give the perfect answer. :thumb:

Why should the passenger who doesnt own the vehicle kana?Like that if a taxi driver got no license then all his passengers also kana?

 

But if you own the car and think the person has no license, then dun let him drive your car.

With all the technology, TP definitely can check for license based on the IC number alone.

 

With regards to your other question, only the owner of the vehicle will be liable if the driver is caught, nothing to do with the passenger unless he is the car owner.

 

Unless the owner says that the vehicle is driven without his permission, the owner has to "show cause" as to why he shouldn't be prosecuted for abetment.

 

For the "no-license" driver himself, it's a no-brainer. Fine plus driving ban.

just to satisfy your curiousity whether this person has a licence or not, get a police officer friend to do a search by IC number.

I think this might be possible.

Passenger has no liability in any case. If driver kena for driving whilst under the influence of alcohol, passenger want to kena for what?? Being drunk and incapable? Like I said, unless passenger is the owner, he has no liability or blame to shoulder...

 

If there is no licenced-driver who is sober, then all have to take taxi. Simple as that... We don't want another drunk driver to run down another biker like at PIE a few weeks back....

Of course the passenger will have NO liability. If passenger has license and has not driven for 20 years, is it safe to even ask him to drive?

Yup. The onus is on the driver. But if I'm the sober passenger with some common sense, either I will offer to drive or refuse to be driven by a drunk driver.

 

Legally, there is no liability on the passenger. Morally, it is a different issue altogether...

Best to check if he does has a license. Police wont take 'i tot, i assume...' as an answer....

 

In e case of any events (ie road block, accident...etc), and if the driver does nt have a license, the police will treat it as a traffic offense.

 

Then insurance will nt cover anything as the driver itself has no license in e 1st place.

 

Y ruin the future for a moment of folly? Can imagine the amount of time wasted in e court case? If really convicted, the punishment can said to be quite heavy, in terms of fine n jail terms.

 

Nt worthy it bro, better be safe than sorry. :thumb:
