Yesterday evening around 7.50pm, my scooter skidded as i was turning into a Shell station. i immediately got back up and pushed my scooter to 1 side to assess the situation. I suffered some abrasion on my left knee, lower leg, elbow and hip and there was some bleeding. But overall not very serious. Also, my helmet visor broke off and the left side mirror as well. (btw, i'm riding a Kymco Granddink 250, the one with mechanised side mirrors)

 

I also realised there was this wet, flaky stuff spread over the left side of my body and leg, where i hit the ground. When i looked back at the road, i saw this stuff was all over the part of the road on which i skidded. It had rained earlier and the road was wet.

 

I proceeded to get my scooter refuelled and before going in to make payment, informed a pump attendant uncle about the flaky stuff and that he should sweep it away to prevent further accidents.

 

After paying for my petrol, i saw the uncle again and he told me that flaky stuff was actually wet, mashed up cardboard ( like those carton boxes) and his colleague had swept it aside.

 

Then it struck me. That's all well and good for the Shell station and future customers but what about me and my scooter?

 

So i went back inside to speak to the manager.

 

To cut an already long story short, i was told that the section of road connecting the main road and the Shell station does not belong to the station. They claim not to be responsible for its upkeep and they have no idea how some carton boxes ended up there to be mashed up in the rain.

 

So, do i now just count myself unlucky and move on? Or do i pursue this matter with the Shell station? Or is it LTA?

 

Would really appreciate any constructive advice from fellow riders reading this. Thank you for reading.

err..which shell station, care to post the map of the road??,

 

n..err...u say the entrance, is it the "cement" part of black "tar part"

 

i dun want u to get confused any further, u may want to send email to LTA and complain abt the road condition enclosing "google satelite" photo with arrow of where u fall and ask them whom is under purview of the road...den proceed the matter accordingly...

 

btw u gt pics of the "wet carton"??? den can enclose also..

imo, count urself unlucky. even if u pursue, all will be pushing blame around, end up u'll have to find the owner of the carton box.

Accident can happen anytime, anywhere.

However ask yourself, do you want to fall at 120km/h or 60km/h?

If you want to pursue, you probably have a good case.

 

Whose road,whose carton box..etc are immaterial. SHELL has the responsibility to keep the access road into their premises safe for motorists at all times. So all your lawyer has to prove is that SHELL did not do their due diligence.

 

Naturally it is always easier to sue SHELL than LTA, moreover SHELL has public liability insurance to cover such incidents, and more often than not, if you compensation demand is not too unreasonable, their insurer will just pay.

 

The surroundings of the kiosk are monitored by CCTV, and hopefully during this lapse, this incident has not been recorded over. Get hold of that uncle, as he will be your witness.

 

Hope you have documentations on your injuries and damages to your bike.

Even if you have high chance of winning, the next question is does it worth the effort?

Finding lawyer, attending court etc :sian:

 

This is a straight forward case, almost certain it wouldn't end up in court. A few rounds of mediation, surely settle.

 

Just get a lawyer to fire a Letter of Demand to test water first. :p

 

In the US, there are people who make a living from such compensation. :faint:

Or,

 

2) Sue their pants off and get yourself a 3-wheeler. That why you will never skid, almost.
