A friend of mine lives in a private condo. There are different levels of parking - the area where most cars are parked (near lifts and entrances) have no bike spaces. (Condo TOP 2+ years ago)

 

when condo went on sale, no bike spaces. Now there are bike spaces but a long way from lifts and not visible without detour. Plenty of bikes parked near lifts. Management committee (MC) started to ask people with second cars to park them elsewhere. Said they would get clamped if illegally parked.

 

Bike owners have complained that the bike spaces are inconvenient. so they continue to park at car level, but not in car lots and not obstructing.

 

My friend had a bike before at a different condo but similar idea. Came back home one day to find bike had been knocked down and petrol was leaking from the tank - a serious fire hazard in an underground car park.

 

MC has decided now to clamp unauthorised parking. My friends bike hd 2 notices left on e bike (within 12hrs) and was immediately clamped after. He was overseas at the time MC put round notice about clamping cars (not bikes) and was overseas when the bike was clamped

 

So how?

 

Can he remove clamp himself? any lawyers here? I could understand if he parked knowing about the clamping, but the notice re clamping, 2 warnings and the clamping itself all happened when overseas

 

should he have to pay the fine? He is a teneant in a private condo - clamped by his own MC in his own car park

Only option, move out of condo and live in a real housing estate.

 

Parking lot is private property of mgmt, no amount of lawyer can help. Mgmt can put a giant penis in the middle of the parking lot and they still have the right to do it.
