Riding with valid license but without insurance. HELPHELPHELP

Hi all,

 

my friend and i was caught on national day after NDP.

On our way back along ECP i was feeling giddy and in the mid of highway i ask my friend to ride me home so we stop at te road shoulder to change rider.

therefore my friend was riding on my bike and me as the pillion.

my friend was holding a valid license but the insurance of my bike does not cover her a the sub-rider.

We were riding at 60km and on the extreme left lane but unlucky enough the TP was riding beside us and stopped us. He told us that both of our license will most prob. be revoked plus fine. I will be charge for abettment for giving consent for my friend to ride and she will be charge to riding without insurance. I am holding a Class 3 and 2B while my friend holding class 2B. I desprately hope that i could keep my class 3 as i really need it for my work as a sales exec. we beg the TP for liency but he ask us to appeal through proper channel which is the MP.

 

The plus point here is my friend owned a bike herself which is a more convincing reason that she is not riding my bike for fun is really that i am not feeling well after the NDP celebration and she riding me home.

 

do anybody have similar cases recently? and what is the outcome ?

As far as i know TP does not give chance no matter what reason u give bro.I am ns spf and i know how Tp style of work. Simply no second chance. It always a proper channel of appealing to the Head of Tp department or best go and see the MP. And i still believe the outcome be a bad news. Well we just have to follow the law bro in this country. Just try ur luck by seeking the MP help.

Felt sorry for you. H/ever find your best reason/excuses. Im not sure how MP could help though.

Be prepare for the worst which is, to be fine and license revoke. Both rider and owner will be charge accordingly.

Get a lawyer for opinions on various options better. Don't wanna you to get false hopes after our assurances.

Most probably your 2B and 3 and your friend's 2B will be revoked. Go public next time when you're feeling giddy; no point trying your luck.

thanks all for your precious advices. its seem very pessimistic...

it will be a tourturing period to wait for the summon letter from TP and as well as the court. but still hoping for the best outcome. will try to do whatever i could by seeking lawyer advice and MP's letter.

i saw a post in this forum from wakuku which experience the same problem as mine in end may 09, i guess by now he should already know the outcome. my case are much similar to his and i was hoping to hear from him as well.

someone ask me to see a doctor and take a MC for today so as to prove that i'm really not feeling well after the NDP celebration and i did consult a doctor and got a mc. hopefully this will help as well.

anyone know if the effective date of revoke will start from the court hearing date or from the date of offence commit?

and is there a installment plan for court fine?

anyway if anyone here know wakuku from the forum pls help me, tks.

be persistent and try hard to use not feeling well as the core reason....dun change your reason.

unless they wan to comprise the rider safetly ..and insists the one not feeling well should ride...

People here...is just not flexible at all...even there come with valid reason...

tell them... lady..some time once a month...loss too much blood will feel giddy also...

When the TP shows leniency for such situation, a hundred more will show up. If they show leniency to you and not other riders, then Singaporean will complain double standards.

 

Hence the best is to keep yourself low profile while trying to seek MP's help. With less publicity, you stand a better chance for they do not wanna publicise that they are able to show leniency for such situation to prevent further abuse.

If riding normally why would a TP want to stop you in the first place?

i dun know but maybe my friend riding not stable enough that why first thing he ask for license first.

Is there any "Mr TP" here in the forum that can give me advice?

what are the chances of retaining my class 3 ? i think for now this is really important to me. i need my license for my work to support my parents and my family. i am really lost now. i might even lose my job for revoking my license.

Look for your MP.No matter wat kinda of reason .The TP have enough of everything.In singapore we need to go through proper methods or channel.Try explaining it to the MP. See What he/she can do for you.

Don't mind me asking, what bike are you riding? Because on my YBR how many times i ride beside TP or TP ride beside me, they never ask me to pull me over. Even at the countless roadblocks i kenna, they never even bother to check me.

But if you hired a good lawyer there is a good chance you get suspended for a few months + fine only .

 

( good lawyers don't come cheap ,are you willing to fork out more than $5K per person to retain your license ?)

If Your License Have To Be Revoked, Confirm Both Class 3 & 2B Will Be Revoked. No Such Thing As Revoke One & Keep The Other. Revoke Means They Really Want You Not To Drive Anything On The Road And Endanger Others.

 

But If You Say Ure Not Feeling Well, Ive Heard Before That The Judge Can Say That By Right, A Rider Must Never Pillion Anyone Who Is Not Feeling Well.

 

If It Really Is True Then How?

 

Maybe You Can Say U Injured Your Wrist or Sumthing?

Or Say That You Had A Bad Stomach Ache & Cannot Focus On The Road.

By Saying Ure Giddy The Judge Might Be Afraid You Might Fall Off The Bike And Endanger Others.

i really dunnoe. im totally lost now. i dunnoe what else i can do. i knw chance are slim. by enagaging lawyer is so costly and is not a garanteed result. 95% pple asked me to approach MP i guess there must be some kind of help or else why they ask me to approach MP.

But maybe somebody with my same encounter can advise me what is their outcome. At least i can at least hope for the best and prepare for the worse...

anyway i'll approach community lawyer for advice as well.. see what is the best situation for me.

Now are all wild guessing which is really torturing.. will update the outcome after consult lawyer at least i could get a definate answer if there are chances to retain my class 3 not.

I Usually Read In The Newspapers Ah. As Long Ure On A Public Road, Riding Without Insurance Is Really Serious ****. To Me It Was Just A Matter Of Wrong Time Wrong Place. I Guess The TP Must Have Seen You Switch Riders That Is Why He Stopped You. Just Come Clean & Appeal For Leniency. Stick To The Truth So They Will See That You Are Honest & You Admit Your Mistake.

Since You Have Clean Records For The Past Years Then Add That Up In Your Appeal. Say This Is Your First Brush Against The Law & You Wont Do It Again.

Say That You Need Your License As Your Source Of Income. Im Sure The Judge Or Investigation Officer Will Have Some Heart In Him.

 

So Far I Have No Friends Who Experienced This Before But I Have Read It In The Newspapers Since I Have Been Reading It Everyday Without Fail For The Past Years.

 

The Best That Can Happen Is Just Stern Warning.

They Will Let You Off But If Youre Caught Again Even For Sumthing Else, They Will Dig Up Ur Old Case & May Consider Pressing Charges On You Eventhough Ur Case Was A Few Years Back.

 

Tell The Judge You Really Learnt Your Lesson & Plead For Leniency. Dont Overdo Your Pleading Because The Judge Might Think Youre Just Faking It.

The revoking of both 2B licences is a certainty in this case. However, you may plead your case regarding the class 3 licence as you need it for your work and your rice bowl will be threatened.

 

I have a friend who was caught speeding (excessively) as he was rushing home after his elderly father had a fall. After several appeals & show proof of his father's medical condition, he was allowed to retain his 2B as his work encompasses going around on a motorbike.

 

In your case, you may offer not to contest the revoking of the 2B however plead for leniency on the retention of class 3 licence. Just make sure in future that when you're not feeling well, find a place to park & go public.

If you're not feeling well, you should park your bike there and take a cab instead of riding home.

 

It is very dangerous to ride when you are not feeling well, especially you are having a life behind you.

thank for your advise but i would like to know does your friend hold class 3 license as well?? as what wanwanwan say once revoke all will revoke.

unless they suspend me maybe 3-6 months? it will be the greatest blessing.

i am really demoralised. No definate answer at all now.
