A car hit me when lane splitting? who's fault?

 

I was lane splitting along Thomson Rd(near Thomson Medical Centre) towards Braddell Rd when lime green Toyota Prius(SDT707XX) turn left and hit the rear pillion footrest area. I didn't fall.

 

Now exhaust support cum pillion footrest all bended. (my visual assessment) His damage = scratched on bumper

50/50 fault?

 

Both of us didnt stop due to traffic conditions.

no its the car fault cause 1st the car hit u and second the car hit near to the back of your bike. if it hit the middle or front of your bike then 50/50.. cheers..

Hmmm... From what you have illustrated (Car moving into left lane and hit your rear), personally i feel it's his fault. But do be mindful that he could argue that you rode into his lane.

There's not enough space for him change lanes. After the hit, the car(behind) left side, scarred like crap

Obviously his fault! If go for inspection his damage is front your damage is rear. Still need to say? Claim him..... But you dun have the car number anyway.

if you just abit beside the lane marking, then u not considered as lane splitting, then u can claim against that car.

For me it depends on how you tell the story. Do report to your insurance ASAP. Taxi Company cannot play play. It could be 50-50. Both may kena penalised, if reported to TP. Its does not mean if hit backside will always kena. As what people thought. Stories does change over time, depending on how good/great the lawyer defending the case is.

 

If the Taxi agree to private settlement, then best. But still do report to your insurance. They can play backside and claim against you. Then will become TP case. They will classify this to Inconsiderate & Careless driving for both (The universal rule). Also depends on the IO in-charge, who he/she favours.

 

Although it is not illegal nor legal (grey area) here to lane split, it does cause danger as cars usually cannot gauge how fast bikes are going. One simple reason for this is that it is not taught in driving centres to do lane splitting. It is always important to lane split with caution. The faster you go, the higher the risk.

I don't think it involves 2 cars right? Only the Prius hit him.

 

TS, you should inform your insurance within 24 hours. Just to cover yourself. Driver can say you are lane splitting and hit his bumper. Its very difficult to prove in this case.

remember the van that crash into the railing in malaysia acouple of days ago, when a malaysia SUV swerve into the lane , what goes around comes around.
