Hi all,

This is my first time getting such suay thing.Can someone advise me what to do? My bike was parked along a road when i went to tuition. Its a private housing estate. I heard a LOUD sound and then i realised that the car from the opposite house hit my bike and went off. I managed to see the whole incident happening but did not take any photos. The car owner came back to the house a few hours later and initially acted like she did not know there was a bike at the road and did not see or hear any bike being hit. But later after scaring her that i have witnesses, she kind of admit its her fault but i'm just afraid that she will back our her words. My bike has alot of scratches and part of my ferrings is cracked quite badly.

 

I need to ask 4 things.

1) What can we do in my situation if she admits her mistakes but does not pay me a satisfied amount? What procedures should i do?

2) What can i do If she denies everything NOW since i got no concrete evidence?

 

3) whats the difference between getting claims through insurance company and getting from private settlement? Coz i am getting the impression that private setlement seems to be a preferred choice for both parties most of the time from what i have read in this forum and from friends' experience. Can someone advise me regd these? esp for the payment part.

 

4) WHat should be a reasonable amount for damage to my bike in the following aspects: Ferring crack at the side mirror location, base of the bike, and near bike seat area. Signal light spoilt, Both side mirror scratched. and how much does it cost to repaint the entire bike? and how much is the depreciation like in my situation ( i know its abit difficult to gauge since u are unable to see the extent of damage.)

It seems like hit and run to me. You can actually make a police report from the very beginning.

 

Qn1) If settle privately, bring your vehicle to a motorshop for evaluation of damage. Get the monetary dealings to be btw her and the shop. Your job in this case is just to send and pick up bike. IF she doesn't wanna pay, claim insurance.

 

Qn2)Report police.

 

Qn3)Private settlement is the lady will pay for ur bike damages. End of story. If claim, might affect her NCD for next year. Not sure abt the duration of repair btw these two methods.

 

Qn4)Bring to motorshop to see.

 

Just one qn, was ur bike parked legally? if ur bike was illegally parking...errr.. im not sure how ur case cld turn out.

 

By the way, my response is just an opinion based on personal experience. Check with the correct people for more accurate answers.

yep ..... first make sure u r not park illegally... For the repairs of fairing, depends on how many piece is cracked ..... and also whether must repaint ....

Yap.. my parking was legal. haha. That part of my arse was covered, lucky... I did went to my own bike shop before going to their designated repair shop. My bike shop quoted me a total of $800, that is without changing my fairing man.. just repaint and touch up..and i didnt even charge them for the taxi fare if the bike goes to repaint which will take about 2 weeks. THEIR bike shop just quote me $500.

Am i able to claim the transport fee for the 2 weeks duration of bike painting rightfully? Not that i want to make this a big fuss, but its always better to overquote than to underquote first. then there's room for negotiation.

 

Ya i thought about using the hit and run thingy in a police report should they back out their part or underpay me.

make out some kind of agreement for her to sign. and also if possible get her to sign some kind of agreement that she she know that its her fault and will pay for any repairs taken for the bike to return to the condition before the accident. find someone to fake the as witness. get some friends or something. act as passer by and say saw the whole incident at what time, car colour,license plate.

agreed..write out in black n white...if she also write a black n whte when its time to collect ur bike,(meanng u satisfied with it)check everything first b4 signing.list out all the damages in the paper. :goodluck: :thumb:

once she admit it was her fault.. write sumtin in black n white to let her sign.. statin its her fault.. nxt bring ur bike n her to ur bike shop to evaluate da damages.. if she not willing to pay dat amount.. ask ur bike shop to claimn frm her insurance.. dat was wat my bike shop told me to do in an event of any accident happen..

i also kana quie same case before if u need help can PM me ...

 

 

wat i do is do a claim at my bike shop...provide the car number n driver name quite simple no need wory as long as your bike is parked(even illegal road like yellow line et) u will still get yr claim. :smile:
