threatening bikeshop

A friend of mine PM'ed me regarding this matter. What is your comment?

I was wondering a few question to ask you.

 

After making remarks on a certain "bike shop", they sent me a PM stating they will sue me for posting offensive remarks. Will they be able to proceed the legal proceeding when I DID NOT EVEN MENTION THE BIKESHOP NAME!?

I only said where it is located, I mean along which stretch of road but there is actually around 3 bikeshop in that area. And in my posting I only said mentioned the first 2 letters of the shop. A few ppl even PM'ed me asking which shop but I insist of not telling it's name to strangers. Only to friends and believe me, I have HUNDREDS of friends riding bikes. So words of mouth will spread like wildfires. I know pretty well that the "bikeshop" can't do a thing as long as I never mention it's shop name. So can I too make a legal proceeding stating that they are harassing me and threaten me even tho I have never mention any bikeshop name?

Fact of the matter is: all businesses no matter how well run will receive complaints.

 

It's how they handle complaints that ultimately win the respect of their customers.

 

A business owner that treats complaints as attacks by customers is one that thinks they are 'superior' to the consumers, which is ultimately false, as they rely on customers for patronage.

 

Thus, nature takes its cause.

I wonder why your friend asked you if the bike shop can sue him when he knew the bike shop can't do a thing.

 

In my opinion, the bike shop can sue your friend and from what you say it is possible that the bike shop will succeed.

 

Your friend is right that he didn't mention the full name but so long as normal readers can identify the bike shop which he is pointing at (with the clues that he has given), then he has effectively revealed the company's name. Few readers not knowing does not translate to most/all readers can't identify the bike shop's name.

 

According to your friend, he has hundreds of friends riding bikes and words of mouth spread like wildfire, that further proves how much damage he has caused to the bike shop's reputation.

 

My suggestion is for your friend to settle the matter quickly with the bikeshop and a sincere apology works all the time. Trying to countersue may not work well in this case. But if your friend can afford the legal fees, why not?

Hi keiff. Thank you for your reply. I have read your other posts as well. Your Other reply really doesn't sound like a consumer to me. Oh well, i think my friend will stay put and waiting for the ball fall in his court. If it does, only the empire can decide if it is in or out. And i'm pretty sure that to find a person guilty can only be decide by a hard evidence. Not assumptions, in a court of law that is.

As what i know, if the bike shop want to sue your friends for posting offensive remarks.

 

1. They must have your friend real name, IC No. & address.

This is a private case, is not a criminal offence that means police can't help. They had to engage a pivate investiator need $$$$$$$.

 

2. Engage a lawyer to send a lawyer letter and demand this & that by when & where, if not they will process to the court.

Dont visit their lawyer or the shop if ur friend do not want to settle this case.

They r smart people, they will c****** ur friend.

 

3. If ur friend did not follow what they had required, they might/might not process to court. Why???

They had to engage a pivate investiator need alot of $$$$$$$. to proof that ur friend is wrong. And evidence what they loss so to demand $$$$$$$$ n this n that.

 

My advise:

Dont counter sue them, as u need a lot of $$$$$$ and time time time.

 

Go to Court u need a lot of $$$$$$$$ and time time time.

I was the one that informed your friend regarding his postings.

 

Here's some points that you might wish to consider as a friend of his:

 

1. My pm to him, was to bring the matter down in a calm and off-the-court method.

2. Your thread here is to bring the matter blown up.

3. Are you financially supporting your friend if it goes up to court?

4. Does he have hard fact proving what he has posted?

5. Refer to post #7 by keiff, he is actually right with regards to the IGNORANCE about using asteriks to "hide" the company name, and you think you are safe? Pardon my words but if you & your friend think so by not mentioning the name, it is ok, you are way beyond silly.

 

I am locking this thread now, if you have anymore things to say, PM me instead. I hate receiving lawyer letters requesting to review all you & your friends IP addresses and such.
