Hi to all the bros and sis out there.

I'm posting on behalf of a friend who needs some help.

 

The story is that my friend was involved in an accident with a taxi. The driver was intoxicated but no action was taken against the driver by the police. Now the taxi company is making a claim against my friend for damages. The taxi company claim that they have technical experts to prove that my friend was at fault. So now my friend is at a total lost. Is there any kind soul out there who can help?

how did the accident happened ? who is at fault .. i think ask ur friend to get a lawyer for advise would be better ..

how can the driver who was intoxicated(u said) had no actions taken by the Police?

 

either he was not intoxicated or our Police is as corrupted as Msia Police.

Let me guess. See how accurate this is.

 

Fren rides, bang into taxi. Maybe taxi fault, maybe fren fault.

 

Taxi driver comes down, Fren not so hurt so maybe both parties decided not to pursue the matter. Fren smelt alcohol on taxi driver and being a newbie, did not immediately call for police to complain that taxi driver was drunk.

 

2 weeks later, Fren receive letter from insurance company that taxi wants to claim insurance.

 

Police was not called on the scene to do a intoxicating test. If done test, and taxi driver failed, of course will have action against taxi driver.

 

But if not, its frens words. Are you sure your fren smelt alcohol and the alcohol wasnt from himself?

How would we give any opinions on this matter when there's not enough details on the facts of the case? If the claimants have evidence then say what evidence they have to prove their case.

the wierd thing is that police was called...

taxi driver fail the breatherliser test and was arrested...

but when he went to take another test at the station he was free from alcohol..

something wrong here rite..

I see. The hand held one is an approximate gauge. The one at the station is the highly accurate one.

 

Now if the breathalyser at the station says free from alcohol, that means totally zero or only trace amounts => no drink driving.

Whereas anything below 35 micrograms will show alcohol present but not exceeding the limit - meaning that the motorist could still be charged for driving under the influence of alcohol if he did not have proper control of the vehicle.

 

Assuming that the motorist was free from alcohol using the machine at the station, then what's wrong was the initial test.

 

Putting that matter aside, then the case depends on the events leading to the accident to see who's at greater fault. What your friend should do is to inform his insurer, and send all letters from the claimant promptly to his insurer to deal with.

I am not trying to be critical here.

 

Can you describe, that taxi driver was driven to the police station in a police car, or he went there by himself?

 

And even if he was tested at the police station. There is no such thing as totally free of alcohol.

 

He may not be considered legally drunk.

 

But as long as he is involved in an accident, with alcohol present in his breath. He is still legally liable for the accident.

 

You get what I am saying?

So now our question is, the portable gauge was wrong? Or the perception of drunk is wrong?

So problem with this story. It wasnt complete in the 1st place.

 

Lets tear it out bit by bit and work things out separately can?

 

 

Rider bang into Taxi

 

Driver not legally drunk.

 

Rider receives insurance letters seeking compensation.

 

Rider needs help on insurance claims issues.

 

What is the injuries of Rider and how many days MC?

 

What was Riders perception of that accident?

 

Rider was speeding, Driver stopped suddenly? Driver didnt check blind spot? Rider was going straight? Or what?
