tp slapped me 6 demerit pt

Hi all

 

need advice on this. In May last year, I was riding along PIE towards Tuas when a van knocked me from behind. (raining and was riding slowly at the extreme left lane)

 

Due to sustain injury and insurance cliam, i lodged a police report. The van insurance eventually paid my damages and medical bill. I tot all was over but recently I received a summon from TP.

 

TP booked me for recklessly riding and slapped me 6 pt and fine $200. I felt very unfair treatment from TP. How can I ride recklessly when the van knocked me from behind and caused the accident. I even checked TP website and found out that under 6 demerit pt, there is not more than $200 for light vehicle under reckless driving. why fine me so much?

 

has any brothers had any of such unfair experience from TP. do you think If I appeal what is my chance of wavier on the summon against me?

Ya as u mention NOT MORE THAN $200 and u got exactly $200, nothing wrong with that.

y not u go down at TP base at Ubi to clarify... if it doesn't work den go to MP... n if still didnt get their attention, call the press..

yeah nothing wrong in that.. but i think something is wrong that tp fine and gave him demerit point.. TS did you lodge your report correctly? from your case, you should have won the case hands down and the fine to go to the van driver..

Even if u won the case & had successfully claim the other party's insurance, TP will still fine u.

a bit weird lei.. my friend encounter the same thing but no points nor fine.. also unfair for rider who got hit from the back to be fine.. like that we riders always at losing end.. haha..

Same thing = kana hit from the back? There're actually alot of other stuffs to consider before issuing the fine.

Stuffs like:

- Place that happen?

- Is the bike moving or stationary?

- Did the bike hit anything government property?

- Is there any other party involved? Pillion or passerby?

- Any witness? How's the rider riding style before he come to a stop, then kana hit by car from the back?

 

My friend kana hit by a cab from the back before at a traffic light junction.

I'm 1 of the witness, but the passenger in the cab claim that he (my friend) is doing lane split & squeezing thru traffic before he stop.

He managed to claim the repairs of his bike from the cab thru insurance & file a personal claim against the driver, but he still kana fine from TP.

 

It's not 'riders always at the losing end' , it've to depend!

In Batam, bikes are ALWAYS right when accident with cars. (even when u're riding a Haya against a Cherry QQ)

thaks for all your replies. hi bro lollypop,can i knw your friend is it also 6 demerit pts plus fine. did he go and appeal? my report was the same as the situation. i did not speed nor lane change. even the police who filed the report stated that such accident is common in rainy days and mostly driver is at fault.

I've forgotten how many pts & fine it was, because it happened more than 3 years ago.

maybe the other party submit some evidence that say it's ur fault.

since insurance is claimed, it can't be retracted.

call up tp n ask if they can provide more details why the demerit n fine.
