Hi bros,

 

a fren coi a bike. now bike still got a few months to go. and then suddenly buyer play punk and take the bike back without my fren's knowledge. Now he do not want to return the bike to my fren. what can my fren do?

 

he had a black and white agreement letter saying that my fren will continue installment and ownership will be transferred once installment is finished.

 

I also dun know how to advise my fren. anybody kena before like this?

well this kind of thing have to go to small court to settle..engage a lawyer...long process...and i believe this is the only way as bike shop and police cant do a thing about it as black n white is between ur friend and the owner...

Agreed with 4th_Espada. The agreement is among your friend and the bike owner. The bike shop does not recognize your friend as the owner. The owner can deny ever agreeing in the first place. The worst case scenario owner can do is when your friend collect the bike, he may inform the authority and insisted that your friend 'stole' his bike.

 

Maybe can slow talk with the bike owner. In the mean time stop all installments. That is the only possible solution from my POV.

Thanks bros. Agree with you both. Option 1) Go small court which i believe is gonna cost more than the bike price or 2)slow talk with owner. sigh. whatever it is thanks a lot.

Only way is to appeal to his conscience that is if there is any left in him.

You cannot make an agreement to circumvent the law.

Very funny how your friend ride the bike without name on it? If the owner add the buyer as 2nd rider then ok.

The case can bring to subordinate court the cost only less than $100 to file no need lawyer.

The seller and buyer will received the letter from subordinate court when to attend court.

Bring the agreement letter which both party sign and the receipt payment. Best if by cheque or GIRO because have record of the name of the person who make the payment. With the payment receipt and agreement letter buyer will win. The loser will need to pay the court fee.
