Nope. It's your fault for not doing your homework before the purchase. It's not like they scammed you. You willingly signed the contract knowing the price, just not the market price. Now that you realise you're paying too much, too late.

SECTION 6 CAPACITY TO CONTRACT

Minors

8.6.1 Under Singapore common law, a minor is a person under the age of 21. The validity of contracts entered into by minors is governed by the common law, as modified by the Minors’ Contracts Act (Cap 389, 1994 Rev Ed).

Contracts with Minors

8.6.2 As a general rule, contracts are not enforceable against minors. However, where a minor has been supplied with necessaries (ie goods or services suitable for the maintenance of the station in life of the minor concerned: see also s 3(3), Sale of Goods Act (Cap 393, 1999 Rev Ed)), the minor must pay for them. Contracts of service which are, on the whole, for the minor’s benefit are also valid. The minor is also bound by certain types of contracts (ie contracts concerning land or shares in companies, partnership contracts and marriage settlements), unless the minor repudiates the contract before attaining majority at age 21 or within a reasonable time thereafter.

Minors’ Contracts Act

8.6.3 Under s 2 of the Minors’ Contracts Act, a guarantee given in respect of a minor’s contract, which may not be enforceable against the minor, is nevertheless enforceable against the guarantor. Section 3(1) of the Minors’ Contracts Act empowers the court to order restitution against the minor if it is just and equitable to do so.

@Cyberpig. Maybe he has been trying for a year. But only now then stumble onto sbf. If he knew sbf to begin with, he may not be posting this thread asking for help.

 

@ts. Well it is a contract so generally u r sux thumb. from a business point of view, especially in cutthroat sg where citizens r being cut, naturally business man will also be a good nice citizen and follow e example and cut their customers where possible.

 

Thus, in all likelyhood, it is impossible to get any mercy from e shop. thus tat option u can forget it unless u noe some powerful pple or maybe some pple who r in very good terms/relationship with e shop. I do not mean other customers since when come to $, customers r still customers.

 

As for coi, i think it is considered illegal? And at e price of ur bike, i doubt anyone would be willing to do a coi at e full amt. Maybe u can consider u pay half someone pay half but he ride u dun ride? But do note tat i do not noe for sure if coi is illegal or not so this is another level of risk. It may cause more problems rather than solve problems.

 

As for case, wat other post ve said is correct. They lay out e price for u and u took it. Thus it seems tat there isnt any cheating involved. Unless u ve some proof tat they quote a different price and u r paying for a higher price. Then u ve a case with CASE.

 

If i were in ur situation and do no wish to bother parents, i will find part time job. Like delivery or something. Or maybe find a extremely low interest loan and pay off e bike first. U ve to do ur own calculations here to ensure tat e $ u loan e interest is lower than e bike. And also ensure tat early pay off do not ve hidden charges.

 

Lastly i agree with e other poster tat u should approach ur parents for help. If ur family is in a terrible state of affairs then approach ur MP an explain ur situation.

 

Last lastly. Hope u will learn ur lesson. Do consider urself moderately lucky as 4.5k is a fairly cheap lesson in e business sense.

yes you can lodge.....every one who think he has aunfair transaction can.

the question is will case take up your case...if case is unwilling...u know the answer to your issus..

if it does...then a good chance of settlement..

 

anyway u need to pay $25 to case..

My motorbike, xlr 200 is still under installment with a bike shop, and COE expire Apr 2013. I bought the bike last year with 1k down payment and monthly installment for 3 yrs which later i change to 2 yrs instead. i count back, total i'm paying $4.480 for a bike which coe expiring apr 2013. Can i or should i complaint to CASE cause i've been trying to talk to the bike shop about giving it back, and even trying to sell to others with just COI but they are not giving face to me and cannot even reloan to new owner. I know it was a BIG mistake buying the bike with that crazy price, one stupid mistake i made last year. I'm still a student and don't want to trouble my parents. My insurance and road tax also expire today. I have no idea what to do. Any advice or help?? for sure i'll get criticism, that's fine. Hope to hear from you guys. Thanks

I don't see how you have any valid reasons to lodge a complaint to CASE. You already said you knew it was a BIG mistake to buy the bike at such a crazy price so now you're feeling the consequences of your own actions.

 

Unless you find another owner foollish enough to carry on your COI, I feel like you might be stuck with the bike till next year. I would suggest getting your parents in and see if they can help. You most probably have to either pay the full amount for the bike now or COI and get a new COE for it next year. Putting it on layup might be a good option too to save your costs. Either way, it's gonna involve more $$$.
