hi, need some advices from you guys.

 

i have a friend who's parked his bike along double yellow line so as to seek shelter in the rain, but his bike was later hit by a lorry when reversing.

 

the lorry jerked when it hit my friend's bike, and knowing that he had hit a bike on the rear, tried to speed away, my friend managed to stop the stupid lorry, but the lorry driver said he couldn't see the bike because of the rain and tell him he sway and all.. and after some talk, my friend gave up on getting claim from the ****er lorry. all the driver said was "sorry" and drove off.

 

what i want to know is, even if we parked illegally, are we still able to claim the other vehicle?

 

lets assume that we have the number plate of the lorry and a witness that the lorry hit his bike, are we still able to claim?

double yellow line means no parking.. but allows immediate picking up or alighting passengers.. just say u just sent ur fren down and about to move off lah den the lorry hit u from behind..

dunno can claim a not. but juz lodge a report n wait e ans. if cant nvm since he says nvm 2 tat FXXKER liao. but if can. tada ur fren will b so happy.

from the situation, ur fren seek shelter coz of rain so stopped his bike at double yellow line. that is fine, police are human beings afterall, they will cut ur fren some slack.

 

also becoz of rain, lorry hit the bike coz cannot see clearly. that one also can cut him some slack.

 

all in all, probably can claim from lorry driver 50% of the damage costs

What do you mean at least 50%...this is a FULL claim against the lorry driver and if it boils down to his words agianst yours at court then so be it!

 

The biker will win ( that is depending on HOW steady he is when he present his case).

 

Parking at double yellow line and getting a full claim against someone who had damage your property are two different issue.

 

Rule No. 100001 : Nobody gets away when he damages your property when your property was not in that physical state before he 'changed the physical state' for you!

 

Live by your principle of righting the wrong against that driver and you'll feel 1000% satisfied after you get your claim!:smile:

it is the responsibility of vehicle owners to look out for hazards and avoid them. Illegal parking is one thing, but it's not lumped together in the case. Worse comes to worst, ur fren can claim him, after that kena 70 dollars fine :p

motorbike A and car B travelling in same direction.. suddenly car B swerve into motorbike A cause car B wanna make a sudden left turn but didnt see bike A there travelling forward.. Car B hit into Bike A. But later when lodge insurance report Car B claimed that Bike A had hit onto it.. so if Bike A lodge a claim against car b? how would The case go? a 100% sure win or a 50%-50% due to Car B roti prata the story?

The car was on the left lane while you were on the right lane? Or were you squeezing on the car's lane?
