Hi all

 

I need your assistance and views on an issue here.

 

For those who drive, its quite clear that when accidents happen, its usually the fault of the driver who is behind rather than the first car. To make clear, for example on CTE, car A is driving in front of car B in the lane. Then dunno what happen and car B kissed car A on the bumper. In this case, car B is at fault no matter what (at least i do not think there is a good explanation for B to bump into A even if A brakes suddenly).

 

For the above case, if car A swerve into the lane that car B is travelling, is car B still at fault if it accidentally kissed car A? You may wish to note that the body of car A is within the lane of car B when the incident happen.

 

What if car B is a motorcycle?

 

What if car B is a bicycle? In this car, bicycle will not have insurance and will they have to pay for the damage to car A?

hmm...

 

the mindset is when a vehicle hits another vehicle's backside, is usually being push the blame... if not taken fully 100% blame.

for cyclists & pesdestrians, if an accident involves tis category, usually the driver is in the wrong right...!?! :sian:

for the first case where car A is in front of car B and the back car hit the front car, the fault is in car B...

for the case where car A SWERVE into the lane of car B, it's all up to both party to fight... car B can say that he has the right of way and car A can say that he was travelling straight... so it's better to have witnesses to prove that car A is in the wrong...

if any motor vehicles hit bicycles or pesdestrains, fault will always be with motor vehicles... because you are trained to look out for DANGER(bicycles and pesdestrains)

If following behind, then car B at fault cos you suppose to keep a safe following distance....

 

If suddenly swerve in, then depends on where car b hit car a then you can go fight it out....

 

If the car hit pesdestrain/cyclist, then the pesdestrain/cyclist may sue the driver for compensation. Then its up to court to decide percentage of fault on either side.

for all the scenario, car A will not be in any fault even if he swerve into car B's lane. if A can swerve into B's lane completely, and B kissed A, B is stupid. singapore road if dont swerve in, u can keep at lane 3/4 all the way liao..

 

if B turns out to be a bicycle, ride away.

depends on hit where. if hit backside at center sure lose liao hit at side of backside. still got small chance hit side of car even higer chance to win.

 

if bicycle hit car although no insurance. the person may engage a laywer to sue teh bicycle rider for compensation.. so all is not lost..
