yo guys...

 

yesterday is a suay day for me.....

 

here is wat happen

 

,XXX, SXXX vehicle owner of FXXXX, have meet an accident which is cause by one of your taxi, SH XXX at Tuas Road In front of SPC station at 1940 Hrs.

 

Driver: Mr XXX, I/C XXXXH was turning right to SPC stations at the entrance and i was exiting from the exit of the station. When i was turning left exiting the station toward PIE, the entrance is just about 10 meters away from the exit, Mr Lim judge that he can turn right to the station before me, never expecting him to turn right, as i am in the major road going straight and he is at the major road turning right to the petrol station. To avoid the accident my immediate action is to jam my brake, due to jam bike was filp upwards and landed on the side damage my front and back of the vehicle. If i have not jam my brake, i would have thrown off the road.

 

The bike was moved to the side and i suffer some scratches and pain in my body, no traffic police is called. After some argument, the driver insist it is not his fault and i say i will be lodging a claim against him. He say ok and he will make a similar report and i hope that he will keep his promise and make the same report. I have also requested CCTV of the SPC station video if needed to check is they have video tape it down. The driver insist to move off saying he has to get a customer's booking and he move off hastily. I am also going to the hospital to access my injury as now it is quite painful and i will be making a police report on this.

 

Please kindly keep this e-mail as record and i have cc a copy to myself.

I also verified that all above are true to my knowledge and no false statement is made.

i have send this mail to comfort and he and call me today saying that he will ensure the driver make a report...

 

my bike is still at home.... and yesterday i make a police report and went to hospital...

 

now the problem is that i did not have any eye witness and no picture take upon removal... of bike..... haiz....

 

anyway is it a must to go IDAC for assessment.... and the claim is like how???

always call the police, if someone is injured. that is what my BBDC instructor told me.

Always ride safely and defensively.

Repair bike cheap and fast,

Repair body expensive and slow.

ya i agree. Since u confirm u are not in the wrong and u are injured, u shld make a big hoo-haa about it and call the ambulance, this way, police will be forced to investigate and the taxi driver cannot remove his vehicle until police arrive. like that u confirm 100% can claim his insurance as the police are ur witness.

the crux is....rider going straight. Taxi turned right.

 

Rider jammed his brake to prevent running into the taxi's side.

 

No damages to Taxi. But rider self skidded and damages & injuries to the bike & rider.

 

No witnesses & ambulance wasnt called in. Neither was TP called in at the moment.

 

Your chances of a successful claim against the taxi driver is slim.

 

Your chance of claiming from your own accident insurance is higher.

 

You need your biked assessed by IDAC as well as your body checked at the hospital to effect a successful claim thru your insurances.

Steps to do a proper KNNBCCB with middle finger.

 

1. Bow down slightly, looking intensely at objective

2. Like a raging bull, hop and jog slowly towards objective

3. Take your left palm and slap it hard on the right mid-arm with a SLAP!

4. With charisma, raise right arm, whilst showing middle finger (with left palm trapped in bend right arm)

5. Shout! KNNBCCB

Seems like my analysis as well....

 

The only way u can succeed in your claim is if you have independent witnesses or video photoage to corroborate your account.

You are right.. even though that is not what the originator of the thread is hoping for.

 

Happened to me before. Taxi made a sudden left turn into the side road without signal just as I was overtaking the car that was following the slow moving taxi.

 

Hit the front brake so hard the bike flipped me over the handlebars in the stoppie that followed. Broke my right collarbone and sustained almost $3k of damages to the fairing of my then CBR929RR. In all this, the bike threw me down the road and it spun and slid on the road just missing the rear the taxi as it turned into the side road.

 

Confronted the driver of the taxi, which had then stopped in the side road to drop off his passenger. He acted totally blur and denied being the cause of my fall. He said that since my bike did not hit his vehicle... I had no case against him.

 

Thinking back about it....I should have not braked but instead should have aimed for the driver's door and hope my bike would slam through the door and kill him instead. Probably would have killed me too.

 

In the end, to put the cherry on the cake... the Traffic Police send me a warning letter for "failing to keep a proper look out" whilst operating my vehicle.

now i only hope that the driver got go and report.... cos i got evidence that he is in the wrong.... if not.... haiz.....

Wrong bro....

 

The police are NOT witnesses. They will investigate accidents with injuries & come to a conclusion. Based on this conclusion, the insurers will weight the parties versions as well as the TP outcome. However, it has to be noted that sometimes the insurers put little weight to the TP's assessment since they did not WITNESS the accident first hand & the vehicles may have been moved prior to their arrival.

 

I find that the best corroborative party is an independent eye-witness, someone entirely not related to either party.
