Today was a rainy day, I parked my bike at Caltex petrol station near Clementi Road, a porsche car reversed into my bike, but I managed to stop it from knocking over, but the back of the car collided with the front wheel, there was a squeaking sound when i front braked, before that, there was none, i had to replace the brake pads, can the brake pads be damaged due to the collision or is it due to build up of rust and moisture as it was raining heavily that caused the front brake to make the screeching sound? Please help!!!

Disc brake, anyway let's say the guy knocked down my bike, how do i go about claiming for damages? My insurance is third party, can i also claim for loss of transport, say i rent a bike during the period when my bike is being repaired, any advice is really appreciated.

If your insurance is 3rd party, it covers the 3rd party, not you (1st party). Therefore you cannot claim against your insurance.

 

You can try to claim against the porsche driver. However, unless you have witnesses on hand or have taken photos of the accident scenario, (e.g. when he knocked down your bike, without moving the vehicles, you take a photo) it will be difficult to make a successful claim.

 

If you wish to make a claim, you need to initiate it through your bike shop or via your self-appointed lawyer. Do note that if the claim is unsuccessful, you may be liable to paying the lawyer fees or workshop fees involved. Usually they will advise you beforehand if it's even worth it to proceed (that's if they are not unscrupulous).

 

So, firstly, did you have any independent witnesses who saw the accident and are willing to put it down in writing? If not, do you have any photos of how the accident happened? If it's just your word against the driver's word, it will be hard to file a claim.

I believe your insurance is comprehensive? If so, you can op for own damage claim which means premium will go up the next time you makes a payment. other wise you can do a 3rd party claim. However, damage must be severe enough. Repair costs must be above 3k. If not, go for private settlement.

 

Loss of use, yes. Depends on your bike capacity. it will be between 20-40 per day.
