Hi all.

 

Fren's bike covered under third party only. Left it at workshop to do some servicing. Then workshop got burnt. Now what's left is a pile of blackened soot and something previously known as a bike.

 

Problem is bike shop is offering a pathetic sum of money which is like a quarter cost of the market price of his bike together with all the accessories. Definitely not going to settle for this.

 

Alternatively, they offered him another bike (same model) but obviously, minus all the accessories and god-knows what kind of condition. He would prefer not to accept this either.

 

In this circumstances, can he do anything to get a value that is deserving of the bike?

Plus, this impedes his movement. No bike, no transport, very difficult to get around. Can he settle for some transport compensation as well?

 

Anyway, he's already made a police report.

The amount the shop offered was what he claims to be reimbursed under the shop insurance.

 

How to go about processing the claim under shop insurance? Via Mitsui?

 

Anyway, if doing the claiming from the shop, is the shop liable to pay any amount at their discretion? Or is it determined by the damage surveyors?

ask him dun bullshit. any normal surveyor wouldn't give a price that's like 1 quarter of the market rate.

 

as for the claiming part, best to check with your insurance, if not check with a lawyer.

Anyway, the fella too distraught now... Will get him to call up Mitsui again tmr and explore the free legal clinic option...

 

If you guys have any other suggestions, please feel free... Would be appreciated.

 

Guys, lets not implicate shop name and location all ya. What's done is done. Would like to avoid any unnecessary and additional legal procedures that might arise from this thread with all the public apologies going on. At this point, the poor guy just needs to check if there's any way he could get some kind of reasonable compensation. Hope you understand.

1st time i hear bike being burnt within bike shop itself .. like wat other users mentioned, only way is to claim against bike shop or bike shop's insurers liao ..

 

Yr frnd might like to check with his own bike insurance coy for advice on how to proceed, and other administrative and legalities issues .. ..

Anyone knows if CASE will be useful in this case? Or going to a direct lawyer would be better?

 

My fren said his insurance told him to go claim under the workshop.

From what you've described, the vehicle was under the care, custody and control of the workshop. Your friend could make a claim for property damage against the workshop. Depending on what happened, the workshop's motor trader insurance could cover these losses. That might be the better way than to accept a private settlement from the workshop for an unreasonably low amount.

 

Your friend should go to a legal clinic and get some views quickly.
