Brought a Rio in June 2007 with C&C and also the insurance by AIG as with the promotion then. AIG premium is on the high side but they have always been considered as a “premium” insurance provider for car so I thought I’ll just get it for the 1st year.

On the 17or 18 of May 2008, I’ve received a letter dated 16May08 for the renewal for the car insurance with the premium higher then last year when it is without 10% NCD. Premium has gone up so I thought I can no longer afford AIG, better start looking for “not so premium” insurance company.

Few days later, I received another letter dated 17May08 for endorsement of policy and the endorsement is that “policy cancelled wef 27Apr08”. I was having my ICT then so I did not even open the letter so I was unaware of this matter. I open the letter only after my ICT and everything has been settled, somewhere after 1June08. Along that time, I did not take note of this seriously enough until LTA send the renewal notice for my road tax. The offence of using a vehicle without valid insurance is fine of $1000 or 3mth prison or both and a mandatory disqualification from holding a licence for at least 12mth.

I called AIG and on 4June and was told that they will look into the problem “urgently”. I called up everyday and was told they are still looking for the document that cancelled the policy. After almost a week, (I called them everyday except wkend) some one called me and said that they can reinstate the policy for me since I need to use the car. I told them I dun need a reinstatement as a favor but I want to know who cancelled it. It is not easy to cancel a policy and need written agreement by the insurer (me, I hope). I wanted the party at fault to pay for my lost of use of vehicle, the more they drag to find out, the more the party need to pay. They then called me on that same day again, saying that it is their fault. They are offering me a $50 voucher as compensation and reinstating my policy.

I told them I expect AIG as a “premium” insurance provider should know how much to compensate for lost of use of vehicle, if it is $50 I would rather not take it. I waould rather expect a proper report and a document explaining why this has happen and what the compensation will be. Today, I receive a just a page of letter from them apologising for a “service shortfall” and enclose the $50 voucher. If this is what they believe that it would be a proper explanation and compensation, I am really disappointed.

Maybe someone here can help me to see what I can do now. All the documents they’ve send me are kept as record. They can increase the premium as they think required but when come to service, this is what consumer gets.

I think the only thing you can do is to go to CASE as the police will not do anything even if you make a report. They will only advise you to make a civil suit. However, in this case, AIG is definitely at fault and it is against the law to cancel your insurance policy without notifying you. By right, you can make them compensate you for the loss of use of your vehicle.

I would suggest that if this is what you're looking for, good luck trying to force it out of AIG.

Since it has offered you reinstatement, an apology and compensation, you aren't likely to get much further even if you tried to press your case to independent third parties.

I'm just curious, but why would that be the case?

Reinstatement, apologies are what should be expected without asking. But compensation of a meagre amount to end things off? I doubt the $50 would make up for the loss of use of the vehicle. It does not sound like a fair response.

And also, is the remaining period of coverage adjusted to make up for the period of non-coverage?

From the dates given, TS has not bought the insurance for the 2nd year although a renewal notice was sent by AIG.

As long as the insurance has not taken effect, the insurer has every right to cancel their offer.

looks like i am not the only one who kena the cancel/reinstate thing from AIG/CC.

for my case, the staff were entirely clueless as to why this had happened when i walked into their office after phonecalls ended up nowhere.

waited 2 hours for them to call up everyone but still no answers. End up, a few pple had to work overtime to make sure i walk out with proper coverage.

no apologies, no nothing. just a smile and a thank you for my money.

oh what the heck, just another bad hair day. at least now i know where not to go nexttime ...

ah leong always say ... dunno? dont do!

In the case of a typical reinstatement, the cover was in place throughout. The policy has been reinstated as if it were never cancelled. In order words, the reinstatement and cancellation endorsements have the same effective date.

Therefore, the question is what loss have you suffered in order to claim compensation for that loss. In most cases of reinstatement, you suffer no loss if you had continued driving as usual (such as the period from April to 4 June below).

If you can prove loss of use and quantify the amount of your loss arising from loss of use, yes you could make a case for that. On the other hand, many people who make such allegations don't back up their own case with quantification of loss - which leads back to the earlier point - no quantification of the specific loss typically means no monetary compensation.

Simple logic. AIG send a letter saying you policy has been cancelled as effect from yesterday, 25Sep08. You receive the letter today, you dare to drive the car now? I guess not because they say they "already cancelled" you policy and if you drive now, you are not covered.

Two weeks later the send you another a letter saying they reinstated your policy as they had made a error cancelling it. You've cannot drive for this two weeks because of their error.

Your statement of "you suffer no loss if you had continued driving as usual" would be irrelevent. Can I don't buy car insurance IF i don't think I'll get into anaccident? There is no IF in such matter, only there IS or the IS NOT.
